In recent years,under the influence of the international situation and geopolitics,regional and international conflicts have continued,and the number of refugees in various countries has continued to rise.The issue of refugee management is a comprehensive international issue that requires all countries to jointly fulfill their international obligations and assume international responsibilities.As a party to the 1951 Convention relating to the Status of Refugees,China has accumulated experience in refugee management in the past and will play a more important role in the reception and management of refugees in the future.However,China has not yet established a legal system for refugee management,and there are still problems such as a lack of systematic legal basis for refugee management,incomplete refugee screening procedures,and inadequate protection of refugee rights.The first chapter of this article is an introduction,which introduces the research background and significance of this paper,the research status and review at home and abroad,the research methods,the structure of the paper,and the innovation points of the research.The second chapter of this article explores the basic theories of the refugee system,introduces the concept of refugees,and introduces the classification of refugees from the perspectives of refugees in a broad sense and narrow sense,extended refugees,key groups of concern of the United Nations High Commissioner for Refugees,temporary protectors,asylum seekers,domestic "displaced persons",voluntary repatriators,stateless persons,and other concepts.It also expounds the necessity of establishing a legal system for refugee management in China.The third chapter of this article provides a detailed analysis of the current situation and problems of refugee management in China.The problems mainly focus on the lack of systematic legal normative documents for refugees,the incomplete integration of refugee legal screening procedures with the standards of the United Nations High Commissioner for Refugees,the unclear responsibilities of refugee management departments,the existence of management "blank spaces" after refugee status applicants are rejected,and the lack of necessary legal basis for refugee rights protection.The fourth chapter of this article elaborates on the extraterritorial reference of the refugee legal system,focusing on international treaties such as the 1951 Convention relating to the Status of Refugees and the 1967 Protocol relating to the Status of Refugees.It also introduces the mature experience of refugee management legal systems in countries in the Americas,Europe,Asia,and Africa such as the United States,France,South Korea,and South Africa.The fifth chapter of this article proposes reasonable countermeasures for building a legal system for refugee management in China.It is recommended to issue the "Regulations of the People’s Republic of China on the Management of Refugees",and to provide preliminary exploration and design on the legislative purpose,legislative principles,and basic legal system of the legal system for refugee management.
