The countryside is the origin of the life of the Chinese people,an inseparable part of the Chinese land,and the foundation of the prosperity and strength of the motherland.Nowadays,with the high-quality development of my country’s economy,the countryside has become a relatively weak link on the road to my country’s great rejuvenation.How to promote the sound and rapid development of the countryside,share the dividends of the times,how to build a modern new countryside,and achieve common prosperity,Has become a new era proposition.In the long-term development of rural areas in my country,the right to land contractual management,as the basic right of farmers to engage in agricultural production activities,maintains the basic living needs of farmers and has an important social security function.Disputes arising from land contractual management rights have become the top priority of our country’s laws.Since the successful convening of the 19 th National Congress of the Communist Party of China,it marks that the construction of the rule of law in my country has entered a new era.The Rural Land Contract Law,the Land Administration Law,and the Interpretation of the Supreme People’s Court on the Application of Law in the Trial of Cases Involving Rural Land Contract Disputes have been amended,so that the results of the "separation of powers" have been confirmed in the law,which not only makes The judicial organs have become more mature in handling disputes over rural land contractual management rights,which represents a huge step forward in my country’s law in dealing with rural land contractual disputes.The right to contracted management of land has been endowed with a new connotation of the era,and disputes over the right to contracted management of rural land have shown new changes and new problems.Therefore,in the context of the new era,how to better handle disputes within the existing legal framework to ensure The legitimate rights and interests of farmers have become a difficult problem before us.Therefore,from the perspective of the new era,this paper studies the disputes over rural land contractual management rights,and is committed to reducing the occurrence of disputes and protecting the legitimate rights and interests of farmers over land.This paper is divided into four parts.The first part introduces the research background,research status,research purpose and significance of this paper,which lays the foundation for the subsequent writing.In the second part,this paper elaborates the new connotation of land contractual management right under the background of the new era,and then introduces the concept,characteristics and types of rural land contractual management right disputes,and explains the necessity of resolving rural land contractual management rights disputes.,through the discussion of the above issues,trying to clarify the theoretical basis of rural land contractual management rights disputes under the background of the new era.In the third part,this article searches through the China Judgment Documents Network,using the keyword "disputes over rural land contractual management rights" as the key word,and analyzes the latest ruling of the Supreme People’s Court in 2020 and relevant cases,and discusses the solution to rural land contracting in the new era.The problems faced by disputes over management rights include imperfect legislation,insufficient judicial protection,irregular law enforcement,lack of government supervision and guidance functions,and imperfect dispute resolution mechanisms.The fourth part prescribes the right medicine,and proposes corresponding countermeasures,namely,perfecting legislation,strengthening judicial safeguards;regulating law enforcement,strengthening supervision and guidance of grass-roots governments;improving diversified dispute resolution mechanisms,etc.In short,through the writing of this article,I try to provide new perspectives and new ideas for my country to deal with disputes over rural land contract management rights,for the country to implement the strategy of "revitalizing the countryside",to solve the problem of land contract disputes,to protect the legitimate rights and interests of farmers,and to provide new impetus for the construction of society.A modernist and powerful country is the escort.
