Although the right to medical treatment is not explicitly listed as a legal right,it is widely recognized in practice.Individuals living in the country as citizens should enjoy the right to medical care equally,and in recent years,the problem of imbalance in social development in our country has become more prominent,and this imbalance also exists in the field of medical and health care.The protection of rights is premised on financial support,and as basic medical and health services are explicitly provided by the government to citizens as public goods and products,the role of financial fairness in the protection of citizens’ equal medical rights has become increasingly apparent.Therefore,on the basis of the right to medical treatment,this paper puts forward the concept of equal medical rights,analyzes the relationship between financial fairness and equal medical rights,and promotes the realization of citizens’ equal medical rights and practical medical equality through the realization of financial fairness.Chapter 1of this article provides an analysis of the concept and status of the right to equal health care.The protection of the right to equal medical care was elucidated,elucidating its focus,principles and rights structure,and it was made clear that citizens’ entitlement to receive medical services from the state on an equal footing is the right to equal medical care.The right to equal health care is theorized.The rationality of Rawls,Sen,and Nasbaum’s social justice theory is demonstrated through its intrinsic requirements of social justice and objective needs of human rights protection.This is further evidenced by the support of equal medical rights in the attainment of civil and political rights,as well as economic,social,and cultural rights.Chapter II discusses the relationship between equal health care rights and financial equity,pointing out that financial equity is fundamental to the realization of equal health care.On the one hand,the realization of the right to equal medical care depends on the national financial taxation to provide material support for it,on the other hand,the realization of the right to equal medical care depends on the rational allocation of medical and health resources,and finance is the basis for the state to fulfill its obligations,with the function of resource allocation,financial fairness as the value concept of financial distribution is very important to the realization of equal medical rights.The third chapter observes China’s achievements and existing problems in recent years in terms of equal medical rights for citizens from the perspective of financial fairness.It is pointed out that there are currently problems in China in the protection of equal medical rights,such as categorical guarantees,uneven medical resources,and poverty due to illness,which are closely related to financial fairness.Chapter 4 combines financial fairness with the guarantee of equal medical rights based on the concept of financial fairness.Fiscal fairness should be achieved through the improvement of the financial system,and then the medical and health legal system should be improved under the guidance of financial fairness,so as to provide legal protection for the realization of citizens’ equal right to medical care.
