Research On Compliance Construction Of Private Enterprises In Y City Of Jiangsu Province From The Perspective Of Gowernment Regulation

With the deepening of economic globalization and world integration,market risks are becoming more and more obvious.In order to prevent and control market risks and ensure the sustainable development of enterprises,European and American countries have successively established enterprise compliance systems,the global compliance management system is also developing and evolving,and effective compliance construction has gradually become the core competitiveness of enterprises.In recent years,the Party Central Committee with the Comrade Xi Jinping as its core has increasingly attached importance to the issue of enterprise compliance construction,and has made a series of important discussions on enterprise compliance from the height of building a new development pattern of international and domestic double-cycle mutual promotion,providing a fundamental basis for all regions and industries to promote enterprise compliance construction.In the report of the 20 th National Congress of the Communist Party of China,it was emphasized that we should give better play to the role of the rule of law in consolidating the foundation,stabilizing expectations,and benefiting the long term,build a socialist modern country in an all-round way on the track of the rule of law,and strengthen the construction of enterprise compliance has become a major issue involving the survival,development and growth of enterprises.With the development of cloud computing,big data,artificial intelligence and other technologies,new technologies,new industries,new formats and new models are emerging,which not only affect our production and life,but also pose new challenges and higher requirements for the current enterprise compliance construction and government governance.Under the guidance and promotion of policies such as "going global" and "the the Belt and Road",Chinese enterprises have begun to extensively and deeply participate in international businesses such as overseas investment,mergers and acquisitions,cross-border trade,international economic and technological cooperation,and international engineering contracting.At the same time,the frequent occurrence of overseas compliance punishment cases by Chinese enterprises has triggered the whole society’s thinking about corporate compliance issues,and the call for building a corporate compliance system that meets regulatory requirements is also growing.It is urgent to study the enterprise compliance construction from the theoretical and practical aspects.The compliance of private enterprises is the basis for the sustainable development of enterprises in the context of the rule of law society.Over the past 45 years of reform and opening up,the private economy in Jiangsu Province has stepped onto a broad road.From the model innovation in the 1980 s to the reform of property rights system in the1990 s,a large number of private enterprises were born in Jiangsu Province.In the new century,the private economy has accelerated its transformation and upgrading,from "three pillars" with state-owned assets and foreign capital to "half of the province’s economy".By 2022,the added value of Jiangsu’s private economy will reach 7.1 trillion yuan,accounting for 57.7% of the province’s GDP,0.4 percentage points higher than the previous year,and 72.2% of the province’s GDP growth.It has made outstanding contributions to promoting the economy of the province.With this huge economic volume,private enterprises must accept the policy supervision of all aspects of the country and consciously carry out compliance construction,otherwise they may be unable to do anything in the new era of market-oriented,legal and international business environment.From the perspective of public management,the challenges of enterprise compliance reform stem from the realistic background and institutional factors of compliance.In this context,this paper,from the perspective of government regulation,using regulation theory and related views,to explore the government regulation to promote the feasibility of non-state-owned enterprises compliance.Based on the implementation process model of Smith policy,this paper analyzes the implementation process of compliance policy of private enterprises in y city,Jiangsu province,the findings are as follows: there are some problems in the implementation of compliance policy,such as the homogeneity of the policy text and the lack of clarity in the policy design;The weak coordination of executive agencies,the incomplete functions of executive departments,and the lack of professional competence of executive subjects aggravate the deviation of policy cognition,and the executives of enterprises are trapped in the dilemma of policy participation,which leads to the feeling of policy resistance,and formalism,lack of funding for compliance and low participation of social forces.Based on the theoretical knowledge of government regulation and the advanced experience at home and abroad,this paper puts forward the optimized path of perfecting the compliance construction of private enterprises in our country,in order to provide theoretical basis and guidance for enterprise compliance reform to solve development problems.
