Research On Enterprise Compliance From The Perspective Of Administrative Supervision And Incentive

As a new means of administrative supervision,enterprise compliance is a reform of the traditional administrative supervision mechanism.Compared with the traditional "severe punishment and severe punishment",the introduction of enterprise compliance mechanism will greatly improve the efficiency of administrative supervision.Enterprise compliance has been paid more and more attention by the judicial and law enforcement agencies.The administrative regulatory departments have also introduced a series of innovative incentive measures in the field of compliance,and established three incentive mechanisms: compliance guidance,compliance lenient administrative treatment and administrative law enforcement reconciliation.But due to the administrative supervision departments and enterprises to "compliance as a regulatory mechanism" the fundamental proposition grasp insufficient,related incentive mechanism faces imperfect legislation,lack of effective standards,for the enterprise to establish compliance management system of incentive,applicable scope is not clear,insufficient information disclosure,lack of cohesion with the effectiveness of other legislation.Administrative supervision is the basis and premise of enterprise compliance.Therefore,the path optimization of compliance incentive mechanism under the perspective of administrative supervision should adhere to the track of legal development based on China’s national conditions,and build an enterprise compliance management system with administrative supervision as the center.By further perfecting the legislation in the field of compliance regulation,strengthen the effective cohesion with other legislation,clear incentive mechanism applicable scope,improve the relevant supporting mechanism,in order to better play to the enterprise compliance as a huge efficiency of administrative supervision incentive mechanism,promote the administrative supervision comprehensive introduction of compliance management mode,and with the deepening of social governance modernization and constantly improve.
