Study On The Legalization Of Death With Dignity

In recent years,healthy aging has become an important issue,and the related issue of legalization of death with dignity has also triggered more discussion in China.The controversy about death with dignity mainly focuses on the concept connotation,scope of application and whether its legalization is legitimate.Some scholars believe that death with dignity is a violation of and trampling on the right to life,while others believe that death with dignity is a guarantee of the basic rights of dying patients.We believe that the legalization of death with dignity is legitimate,on the one hand,it conforms to the basic value of the law,guarantees the right of life as well as the freedom of death,reflects the value pursuit of human dignity,in line with the basic value of traditional patriarchy to the principle of individual autonomy;on the other hand,it has the profound ethical basis,reflects the humanitarian principle,and the legalization of death with dignity has urgent social reality.On the basis of drawing lessons from the legislative practice and enlightenment of the death of dignity in other countries and Taiwan region,we choose the legislative mode of combining unification and division,adhere to the human value orientation,carry out the legislative work of the death of dignity with the right of the death of dignity,and at the same time take into account various basic principles,so as to promote the localization process of the legalization of the death of dignity.
