Legal System Of Maternity Security From The Gender Perspective

The legal system of maternity security is a legal system in which the state and society provide social security such as time security,economic subsidies,childcare security,and employment support during the process of childbearing.Maternity protection is an important part of the social security,and sharing the cost of maternity to a certain extent is very important to protect reproductive rights.China’s law on maternity protection include Population and Family Planning Law of the People’s Republic of China,Social Insurance Law of the People’s Republic of China,Law of the People’s Republic of China on the Protection of Women’s Rights and Interests,the Special Rules on the Labor Protection of Female Employees,regulations on local population and family planning,and regulations on the implementation of maternity insurance.However,the full realization of individual fertility will is restricted by some factors,and there is a tension between individual fertility desire and national population demand,so it is necessary to incorporate the gender perspective,fully consider the development of gender equality and the particularity of female fertility subjects,then achieve "healthy birth and child development" as well as the "appropriate fertility rate".In order to implement the maternity protection law and realize the goal of Maternity protection law,let the people share the fruits of development,we need to improve the lack of social responsibility sharing in Maternity insurance law,raise the awareness of gender equality in "pregnancy-childbirth-lactation" inclined protection legislation,solve the problem of maternity leave law solidifies social gender division of labor.It is suggested to share the birth cost with diversified economic subsidies,weaken the gender division of labor in the public and private sectors with the balance of maternity leave distribution,improve the multi-level social care security system and improve the relevant laws against birth discrimination,so that the maternity protection law of social gender equality can ensure the individual values,the reproductive rights,the coordinated realization of national population expectations and the individual fertility wishes.
