Research On Non-Litigation Settlement Mechanism Of Tourism Property Disputes

With the rapid development of social economy,tourism has become the main way for people to relax,effectively resolve the disputes over tourism property,in order to build a harmonious society and promote the healthy development of tourism under the rule of law.Tourism property disputes are a special type of civil disputes in our country,therefore,in dealing with tourism property disputes,we must follow the principle of efficiency first and respect the parties’ choice of procedure,in order to achieve the goal of "controlling the source" of tourism property disputes.Although traditional litigation methods are important,a single way to resolve tourism property disputes is not enough to deal with the effective settlement of tourism property disputes.Some achievements have been made in the active exploration of non-litigation dispute resolution mechanisms,such as the establishment of a special people’s mediation Committee for tourism disputes and the tourism arbitration Center.In terms of the connection between non-litigation and litigation mechanisms,Some local courts have formed a mode of "litigation and mediation docking" through the connection between mediation and litigation mechanism,and the establishment of this mode is conducive to the establishment of non-litigation dispute settlement mechanism.At present,the non-litigation resolution mechanism of tourism property disputes still has some problems,such as weak legal foundation,different types of non-litigation dispute processing modes have not formed an overall scale,and consumers lack rational awareness of rights protection.By improving the legal system of non-litigation settlement of tourism property disputes,optimizing the non-litigation settlement methods of tourism property disputes,and improving the legal quality of the main body of tourism disputes,a new mode of resolving tourism property disputes should be established.
