A Study On The Enlightenment Of South Korea’s Diversified Dispute Resolution Mechanism In China

The use of national judicial resources,through the people’s court ruling the relevant civil disputes is the so-called litigation resolution mechanism.In recent years,China’s economic development is very fast,social contradictions have begun to highlight,its characteristics are sudden and group.In view of this contradictory characteristics,if the use of judicial proceedings to resolve,obviously very difficult.In view of the current civil dispute resolution mechanism in China,only to continue the reform,can effectively enhance the level of work in this area.This means that the need to reform the traditional concept of litigation,the traditional concept of litigation need to be abandoned,the civil dispute resolution mechanism through innovation to make it diversified,at the same time,the need for the current legal mechanism for dispute further improved.This can not only fully reflect the respect for civil rights,but also to protect the rights of citizens to provide a wide range of security channels.In our country,the solution mechanism of innovation dispute,innovation and diversification of the solution mechanism is undoubtedly the inevitable way out.This paper is divided into five parts:the first chapter,introduction.Put forward the research purpose,significance,scope and methods;The second chapter,basic overview of diversified dispute settlement mechanism.Starting from the connotation,characteristics and necessity,respectively analysis of diversified dispute settlement mechanism of the theoretical knowledge;The third chapter,diversified dispute settlement mechanism in our country the status quo.First of all,starting from the status quo of diversified dispute settlement mechanism of our country,analyzed dispute solution mechanism in our country’s relevant legal basis,in addition,points out the problems existing in the dispute settlement mechanism in our country at present.The fourth chapter,Korea diversified dispute settlement mechanism.Analysis on the ADR of South Korea,South Korea’s ADR out of court conciliation,mediation and specific measures;The fifth chapter,the south Korean diversified dispute settlement mechanism on our country’s enlightenment.South Korea in the dispute resolution(ADR)has advanced applications,can use for reference the experience of South Korea’s dispute settlement mechanism in our country.At the same time,to improve the legislation of diversified dispute solution mechanism in our country,strengthen the joint application of judicial procedure and non-legal procedure,to build the perfect diversified dispute settlement mechanism,maintaining social order.
