At the end of 2019,the COVID-19 broke out globally,causing production obstruction,life restriction,economic stagnation,and serious damage to the normal global social order;On January 8,2023,the National Health Commission officially announced the renaming of COVID-19,the lifting of the prevention and control measures for Class A infectious diseases infected by COVID-19,and the implementation of "Class B and Class B management",marking a new stage of epidemic prevention and control in China.In the early stages of the epidemic,with the cooperation of the government and enterprises,China launched the innovative mobile governance tool of health codes.The widespread application of health codes is a milestone in the modernization of China’s national governance system and governance capabilities,and is of great significance for promoting digital governance,implementing the national big data strategy,and building a data China;In the "Class B and Class B management" stage,the development direction and legal regulation path of health code application are more worthy of in-depth research.It is worth noting that events such as the "Zhengzhou Red Code Event" and the "Whole Region Red and Yellow Code Granting" in Minquan County,Shangqiu City,Henan Province have exposed problems in the application of health codes in some regions of China.At the same time,the application scope of health codes continues to expand,and its legitimacy is questionable.Therefore,under the new background of "Class B and Class B control" of novel coronavirus infection,this thesis puts forward the following suggestions: first,improve the regulatory basis,including combing and integrating the current legislation,promoting local administrative legislation and other contents;The second is to strictly enforce government responsibility.Focusing on clarifying administrative entities,promoting government information disclosure,and promoting data exchange between governments;The third is to build an effective public-private cooperation mechanism.Refine the administrative supervision system and construct a platform for government enterprise cooperation;The fourth is to improve the administrative relief mechanism involving health codes.Mainly including protecting citizens’ basic rights,expanding channels for citizen relief and compensation;The fifth is to standardize the transformation and exit mechanism of health codes. |
