Research On The Compensation Standard For Property Damage Caused By Wildlife

The harmonious coexistence between man and nature is one of the important characteristics of Chinese-style modernization.At present,the wildlife protection work in China is getting more and more advanced,but the compensation work for the harm caused by wildlife is difficult to satisfy people.Up to now,only ten provinces,municipalities directly under the Central Government and autonomous regions in China have issued compensation measures for wildlife damage,but in the existing compensation measures,the compensation standard has some problems,such as the overall compensation ratio is too low and the compensation ratio varies greatly in different regions.The compensation standard has a vital role in the compensation method,which directly affects whether the loss can be made up.Therefore,it is necessary to study and analyze the compensation standard of wildlife damage in China,and put forward suggestions for perfecting the system.The damage caused by wildlife is usually divided into two types: personal damage and property damage.This thesis only studies the compensation standard for property damage.This thesis first explains the concept of wildlife accident and compensation standard,then combed the existing compensation standard in the legal system in our country,summarizes the defects of the compensation standard on the legal level,followed by a few domestic typical compensation cases,analyzes the difficulties in the implementation,including the parts of legislation blank and the deviation about the understanding of the compensation standard and so on.Finally,we try to put forward specific solutions,explaining how to promote the legislation and revision of the law in the blank areas of the compensation standard and the lagging areas where the compensation standard is issued,such as the establishment of the supervision and assessment mechanism;and put forward some feasible measures to solve the difficulties of raising the compensation standard nationwide.Such as the establishment of a special relief fund and the strengthening of state financial support;the difference of compensation standards in different regions can be solved by allocating the underdeveloped areas separately and accelerating the implementation of the wildlife damage insurance system in such areas.Comprehensive efforts from all aspects to achieve the purpose of optimizing China’s compensation standards on damages caused by wildlife.
