In recent years,China’s wildlife protection work has made great progress under the development of the national ecological civilization construction work,and the number of wild animals has therefore increased.At the same time,the number of wildlife damage events also began to show the upward trend,and the frequent and serious wildlife damage phenomenon has increasingly attracted people’s attention.Chinese citizens can seek relief from the local people’s government according to the provisions of the wildlife Protection Law,but China’s superior law only stipulates the compensation responsibility subject and the compensation scope of the wildlife damage in China,so we need to rely on the local compensation method for wild animals Other contents of the injury compensation shall make specific provisions.After reviewing the local legislation,it is found that there are many problems in the compensation methods for wildlife damage in various regions,such as unclear responsibility sharing of compensation subjects at all levels,narrow compensation scope,unreasonable compensation standards,and the compensation funds mainly rely on local finance.In order to improve the compensation system for damage caused by wild animals in China,make up for the losses of victims,and ensure the people’s livelihood,based on the current situation of our system,combined with the experience of foreign systems,analyze the specific measures to improve the compensation system for damage caused by wild animals in China.First of all,we should define the basic principles of damage compensation,and determine the proportion of responsibility sharing between the central finance and local government finance,and between local governments at all levels,Adjust unreasonable compensation standards,raise compensation standards for property losses,and unify compensation standards for personal injuries;In addition,we should also expand the scope of wildlife,and include the indirect losses caused by wildlife damage in the scope of compensation for wildlife damage;Finally,establish a compensation fund for damage caused by wild animals and promote public liability insurance for accidents caused by wild animals to replace a single source of compensation from local finance,truly alleviate the conflict between human beings and animals,and promote the harmonious development of society.
