Research On The Legal System Of Forestry Carbon Sinks Trading In China

“forests are reservoirs of water,money,and grain,and now we should add a carbon‘reservoir’” was pointed out when General Secretary Xi Jinping participated in the capital’s voluntary tree-planting activities.The important statement made by General Secretary Xi on “forests are carbon reservoirs” means that forests are endowed with more profound connotation.During the “14th Five-Year Plan” period,the carbon neutrality goal proposed by China is a strategic choice to uphold the harmony between humanity and nature,and it is also the only way to base on the new development stage,apply the new development idea and structure a new development framework.Forestry carbon sequestration with the inherent ability to absorb and store carbon dioxide is an important nature-based solution to the goal of “carbon neutrality” and plays a fundamental,strategic and unique role in addressing global climate change.Therefore,studying the legal system of forestry carbon sequestration trading is conducive to providing institutional guarantee for the development of forestry carbon sequestration and providing theoretical support for promoting the green development of forestry in China.This article elaborates on the theoretical basis of forestry carbon sequestration trading and the practical situation of forestry carbon sequestration in four pilot provinces and cities in China,providing theoretical guidance for improving the legal system of forestry carbon sequestration trading.It summarizes that there are problems in China’s forestry carbon sequestration trading legal system,such as a lack of comprehensive legal system,incomplete property rights legal system,non-standard market legal system,and incomplete regulatory legal system.At the same time,it focuses on analyzing the reasons for the problems in China’s forestry carbon sequestration trading legal system.In addition,drawing on the experience of foreign countries in the legal system of forestry carbon sequestration trading,suggestions are proposed to improve China’s forestry carbon sequestration trading legal system: establishing a comprehensive legal system for forestry carbon sequestration trading by formulating specialized forestry carbon sequestration trading regulations and strengthening forestry carbon sequestration trading regulations;improving the legal system for forestry carbon sequestration trading property rights by clarifying the ownership of forestry carbon sequestration property rights and promoting the circulation of forestry carbon sequestration property rights By expanding the main body of forestry carbon sequestration trading,promoting the legalization of forestry carbon sequestration rights,and establishing an effective pricing mechanism,we can standardize the legal system of forestry carbon sequestration trading market,establish specialized regulatory agencies,and strengthen market and ecological environment supervision to improve the regulatory legal system of forestry carbon sequestration trading.By adhering to problem-oriented and systematic thinking,we aim to provide ideas for solving the problems in China’s forestry carbon sequestration trading legal system,while also contributing to the realization of the “dual carbon” goal and the construction of a beautiful China.
