Technological progress brought by industrial society has made the connection between intellectual property rights and market economy more and more closely.It has become the government’s goal to create a good business environment for intellectual property rights through the construction of intellectual property public service standardization,and to provide high-quality and efficient intellectual property public services to the public.Some pilot works have been carried out successively over the years.As the main undertaker of public function,the government should also meet the requirements of the construction of Chinese rule of law while providing public services,namely,the rule of law,the ruling of law and the administration of law.Therefore,under the new trend of the government’s intellectual property-related work,it is necessary to use legal thinking to escort the construction of intellectual property public service standardization.This paper clarifies related concepts,clarifies the dominant characteristics of the government in the standardization of intellectual property public services,and then demonstrates the necessity and feasibility of the standardization of intellectual property public services from the aspects of policy and law.Then,the paper discusses the mode selection of standard system and the essence of the construction mechanism of the standardization of intellectual property public service.Finally,the author puts forward the legal thinking and concrete implementation measures of the construction of standardization of public service of intellectual property by using legal thinking,namely,first,to improve the relevant legal basis of the construction of standardization of public service of intellectual property;Second,abide by the purpose of standardization work,change the direction of government policies;Third,the establishment of intellectual property public service standard system.
