Research On China's Digital Trade Rules Under The Perspective Of Bilateral Agreement

With the rapid development of digital economy,digital trade has ushered in great development opportunities.The simple,flexible and effective features of FTA have become the most effective means of digital trade rules.By analyzing the current situation of China’s digital trade rules from the perspective of bilateral agreements,this paper summarizes the legal issues of China’s digital trade rules from the perspective of bilateral agreements,and proposes suggestions to improve the existing problems of China’s digital trade rules from the perspective of bilateral agreements by analyzing the extraterritorial legislative practice of relevant issues.First of all,the introduction introduces the background and significance of the research on China’s digital trade rules from the perspective of bilateral agreements,and sorts out the research status at home and abroad.Secondly,the first chapter of the text mainly combs the basic theories of digital trade rules from the perspective of bilateral agreements,clarifies the basic concepts of digital trade,and expounds the current situation and problems of digital trade rules from the perspective of bilateral agreements.Thirdly,the second chapter analyzes the legal status quo of China’s digital trade rules from the perspective of bilateral agreements,which mainly includes three parts.The first part is an overview of China’s bilateral digital trade rules.The second part summarizes the law of China’s digital trade rules from the perspective of bilateral agreement on the basis of general situation.The third part is the necessity and feasibility analysis of improving China’s digital trade rules from the perspective of bilateral agreements.Then,the third chapter analyzes the extraterritorial legislative practice of FTA digital trade-related issues,so as to extract feasible suggestions suitable for China’s development.Finally,the fourth chapter of the text is the feasibility of improving the template of China’s digital trade rules from the perspective of bilateral agreements.The main research results of this paper are as follows:(1)From the perspective of bilateral agreements,China’s digital trade rules are characterized by relatively basic agreement content,lack of international frontier,broad agreement constraint content and more emphasis on national security.(2)Paperless trade,electronic authentication,electronic signature and digital certificate,and tariff are the main concerns of countries under the digital trade e-commerce of China’s bilateral FTA.International in-depth issues such as cross-border electronic transmission are rarely mentioned.The main innovations of this paper are as follows:(1)Analyze and summarize China’s digital trade rules from the perspective of bilateral agreements,and supplement and improve the existing theories.(2)This paper studies and analyzes the digital trade rules of China’s bilateral FTA from four aspects: market access,digital trade facilitation,e-commerce users’ rights protection and national data supervision,and puts forward specific suggestions to improve the rules.
