With the explosive development of digital technology and the deepening of global integration,international trade has been redefined,the boundaries between goods and services have gradually blurred,and the proportion of digital trade in the global economy became increasingly larger.In view of this,countries have begun to formulate digital trade rules that reflect their own interests,in order to take the initiative in shaping the digital international economic rules.Under the circumstances,the United States,as one of the cradles of Internet technology,first started domestic legislation and attempted to lead the rulemaking at the international level.With the United States bill blocked and stalled under the multilateral framework,the United States turned to the implementation of its own digital trade concept under the framework of free trade agreements,in addition,it introduced a systematic "American-style digital trade rule paradigm" ahead of other countries.In view of the huge impact of digital trade and the trend of expansion,China listed the“digital economy" as an important agenda for economic innovation and growth at the G20 Summit in 2016,and stressed it in the report of the 19th National Congress of the Party,the "Belt and Road",The "Leadership of Xiamen" and other documents and reports.In this context,this article takes the digital trade rules under the framework of the United States Free Trade Agreement as the research object,studies its development stages,development dilemmas,and compares and analyzes the existing rules under the multilateral framework.Finally,based on the US dilemma,the article gives suggestions with regard to domestic digital trade rules standing for ChinaThe text of this article is divided into four parts:The first part introduces the basic theoretical knowledge of digital trade,including the definition of digital trade and digital products.Based on this,it combs the legal sources of existing digital trade rules in the United States at the domestic and international level,and focuses on the United States.Free trade agreements and digital trade rules under the WTO multilateral framework;furthermore,at the end of this section,the need for research on digital trade rules in the United States is pointed out;The second part summarizes the development of U.S.digital trade rules under the framework of free trade agreements from the perspective of text analysis,and summarizes them into bilateral digital trade rules in the primary stage,regional digital trade rules in the framework formation stage,and the recent "US-Mexico-Canada Agreement." Innovation and upgrading stage under the representative;The third part points out the core dilemma of digital trade rule formulation under the United States Free Trade Agreement based on the development history of the previous article,that is,the rule formulation of digital products under digital trade,and further from the definition of digital products and the application of rules,tariffs Issues,exceptions,and other three aspects discuss the predicament of digital product rules in detailThe fourth part is based on the analysis of the current status of China's digital trade rules,analyzes the industrial differences between China and the United States in the digital field,and puts forward specific suggestions for the formulation of China's digital trade rules in the light of the development difficulties of the US digital trade rules.
