Research On Legal Issues In Combating Transnational Telecommunications Fraud Under The Lancang-Mekong Cooperatio

In recent years,it has been difficult to curb the high incidence of cross-border telecommunications fraud in the Lancang Mekong Subregion.Transnational telecommunications fraud has become a non-traditional security challenge that Lancang Mekong countries are currently facing.In order to curb cross-border telecommunications fraud,it is necessary and urgent for Lancang Mekong countries to carry out regional cooperation.Based on the current situation of cooperation among Lancang Mekong countries in cross-border telecommunications fraud crimes,Lancang Mekong countries need a common and normalized regional governance mechanism to coordinate crime crackdown cooperation..The "Lancang Mekong Cooperation" jointly established by the Lancang Mekong countries provides new governance ideas,cooperation platforms,and legal frameworks to address this issue.The first part of this article provides a brief overview of the emergence and development of the Lancang Mekong cooperation and analyzes the current situation of cross-border telecommunications fraud crimes in the Lancang Mekong subregion.The second part compares and analyzes the breakthrough and development of the Lancang Mekong Cooperation Mechanism on the existing legal mechanisms involved in combating transnational telecommunications fraud crimes in the Lancang Mekong Subregion.Based on the analysis of the above current situation,the third part proposes that there are still issues such as conflicts of criminal jurisdiction,weak legal foundation,weak political mutual trust,insufficient criminal judicial assistance,and inadequate cross-border law enforcement cooperation mechanisms that need to rely on the Lancang Mekong Cooperation to curb transnational telecommunications fraud crimes.The fourth part proposes targeted suggestions on how to strengthen cooperation in combating transnational telecommunications fraud crimes under the Lancang Mekong Cooperation Mechanism,mainly including ways to alleviate criminal jurisdiction conflicts in transnational telecommunications fraud crimes,signing the Lancang-Mekong Cooperation Convention on Combating Transnational Telecommunications Fraud Crime,improving law enforcement cooperation mechanisms,and improving criminal judicial assistance mechanisms,promoting cross-border telecommunications fraud as a key project in the Lancang Mekong cooperation and take measures based on the principle of benefit sharing as an important support.
