| Blockchain is a novel data encryption structure that involves distributing ledger data across multiple data blocks and maintaining information security through a consensus mechanism.The principle behind this technology is to cryptographically secure and maintain information integrity by using a distributed ledger system.The proliferation of patents in the blockchain field and its broad application prospects create a pressing need for increased technological innovation and the enhancement of legal regulations.However,the development of new technologies also poses an increase in social risks.On the one hand,the patent system,as a representative of modern legal systems,presents potential risks due to its modernity,which could include legal decision-making or system failures,or the patent object itself,which is at risk due to insufficient regulation during technological development.On the other hand,inadequate laws and policies that fail to keep up with technological advancements or guide new technologies may have an adverse impact on social values and frameworks,causing significant harm.Therefore,the key to promoting the correct development of blockchain technology and new protection objects is to comprehend the authorization rules of blockchain patents and establish and improve the development and governance framework of new technologies.This article employs the SSP paradigm to conduct an in-depth study on the risks of blockchain patents.Firstly,the article outlines the concept and characteristics of blockchain technology and the current status of blockchain patent applications.Then,based on the analysis of the legal status and protection paths of blockchain patents,the article summarizes the problems currently existing in blockchain patent protection,including disputes over the patentability of blockchain technology,the lack of unified "exclusionary" and "limiting" protection for blockchain patents,conflicts between the monopolistic protection of patents and the open-source nature of blockchain code,and the uncertainty of the examination effect of blockchain patents.Subsequently,using the SSP paradigm,the article discusses the technical characteristics of blockchain patents from the perspective of state-structure-performance,analyzes the technical structure of blockchain patents,and finally derives the technical risks of blockchain patents,including the lack of regulation of decentralization,potential risks of affirming the concept of decentralization,the opposition between patent protection and open source,data disclosure and privacy issues,anonymity and accountability issues.The primary research outcomes of this article are as follows: Firstly,a comprehensive overview and definition of the current state of blockchain patents were provided from technical and institutional viewpoints.The literature review revealed that few related studies have been conducted at home and abroad,indicating the value of the discussion and summary.Secondly,a thorough analysis of the issues and potential risks of blockchain patents in China was performed,providing some guidance for the technical and institutional reforms of blockchain patents.Thirdly,the SSP paradigm was introduced to analyze the patent performance of emerging technologies,such as blockchain,which has methodological implications for promotion.Fourthly,based on the research findings,this article put forward ideas and specific recommendations from the perspectives of technical examination,legal regulation,and technical guidance to address the risks associated with blockchain patents identified in the analysis. |
