Research On The Detection Of Trademark Crime Cases In The Context Of Internet Plus

When conducting online and offline face-to-face transactions,consumers can directly perceive the quality and style of products and other relevant factors that affect whether they buy or not.In this mode,consumers will not deliberately pursue brand-name products.In the network virtual transaction mode,consumers can only understand the product through the text introduction and picture display of the product and other consumers’ evaluation of the product.At this time,the purchase depends more on the brand effect of the product.As a result,taking advantage of the rapid development of the Internet and e-commerce,more and more people are attracted by the high return and low cost of making and selling counterfeit goods,ignoring the law,and investing in trademark crimes by taking the form of counterfeiting registered trademarks,which has hindered the protection of intellectual property rights in China and further affected the investment environment in China,so that China has been denounced by the international community as a "big country in making and selling counterfeit goods".In addition,because the virtual nature of the Internet and the immaterial nature of trademark crime have a natural fit,the traditional trademark crime is gradually transferred to the online,and the relationship between the two is becoming closer and closer,resulting in more losses and greater harm.How to investigate and crack down on trademark crimes in the "Internet plus" environment,and how to prevent and reduce such crimes from the source,this article will analyze and discuss from four aspects.The first chapter is the introduction of this paper,which mainly introduces the research background,significance and methods of this paper,and introduces the current research status of this issue at home and abroad.The second chapter gives an overview of trademark crime cases in the context of "Internet plus",mainly introduces its concept and its clarification with related cases,as well as the related charges involved in such crimes,and summarizes and analyzes its current characteristics and the reasons for its high incidence.In terms of characteristics,it is mainly explained from five aspects,such as organizational form and crime platform,that is,joint crime is the main organizational form,and the industrialization trend is more obvious;Transfer from large platform to small platform,and traditional e-commerce to social e-commerce;Production and marketing are separated into the normal state,and the characteristics of cross-regional and cross-border crimes are more prominent;Using self-built websites and third-party payment transactions,criminal means are more hidden;The Internet and trademark crime have a natural fit,and the victim groups are more extensive.In terms of reasons,it mainly includes the attraction of huge interests of trademark crime;The light punishment leads to the existence of fluke psychology;The Internet facilitates such crimes in disguised form;Intellectual property protection awareness is weak.The third chapter focuses on the current difficulties in the investigation of such cases,including the single source of clues and the difficulty in finding criminal acts;The key evidence is not easy to obtain,and it is difficult to characterize the criminal facts;Virtual identity is complex and changeable,and real identity locking is difficult;Online and offline are intertwined,and it is difficult to crack down on the crime chain;International and domestic cooperation is not smooth,and cross-regional cross-border evidence collection is difficult.The fourth chapter is the main part of this article,which focuses on the investigation countermeasures of this kind of case in combination with the actual situation of investigation and handling,including five major contents: first,expand the source of case clues through multiple channels;The second is to collect evidence comprehensively and accurately determine the nature of the case;Third,strengthen the application of big data investigation technology;Fourth,dig deep into criminal facts and comprehensively promote investigation;Fifth,smooth the channels for international and domestic police cooperation.
