Research On The Rights And Interests Protection Mechani Sm Of Contemporary Female International Migrants

With the in-depth development of globalization and the change of the global industrial structure,the number of female international migrants is increasing.In 2022,the number of female international migrants accounted for 48.0% of the total international migrants.However,the enjoyment of rights and interests is not equal to the “ half of the sky ”: female international migrants are extremely vulnerable to gender-based violence in the process of migration,and even become the target of cross-border human trafficking.After arriving in the country of destination,they also face the risk of lack of social rights protection,gender discrimination in the workplace,being recruited into forced labor or forced to work in the porn industry.Achieving gender equality and protecting women’s rights is the unfinished business of our time and the greatest human rights challenge in the world today.The research on the protection mechanism of the rights and interests of female international migrants can safeguard the personal safety and rights and interests of female international migrants and promote the development of themselves;it is helpful in analyzing the causes of the rights and interests of female international migrants and the shortcomings of current protection mechanisms,exploring feasible ways to improve the international protection mechanism,and promoting the protection and governance of women international migrants around the world.Therefore,this paper adopts problem-oriented research methods,interdisciplinary research methods and literature research methods,with the improvement of the rights and interests protection mechanism of female international migrants as the starting point.It is carried out from the following parts: firstly,it expounds the current situation and rights damage characteristics of female international migrants according to the four types of labor migrants,marriage migrants,victims of human trafficking and refugees.It also analyzes the reasons for the damage to the rights and interests of female international migrants: the subjective discrimination caused by the dual identity of women and migrants,the differences in governance effectiveness between countries,and the influence of various factors such as law,facts,internal and external factors.Secondly,it summarizes the types of current rights and interests protection mechanisms from the global,trans-regional,regional and inter-national levels.It is pointed out that there are some defects in the current international protection mechanism,such as the shortcomings of international legal mechanisms,the lack of enforcement of international organizations,the lack of victim identification and protection mechanism,and so on.Finally,it explores the ways to improve the protection mechanism of the rights and interests of female international migrants from the aspects of improving the legal mechanism,enhancing the executive power of international organizations,optimizing the identification and protection mechanism of victims,promoting gender equality and opposing gender discrimination.
