Nowadays,with the rapid development of science and technology,various emerging technology industries haves prung up like mushrooms after rain.Countries around the world generally attach great importance to the healthy development of the patent system and the entire intellectual property system.In the process of economic development in Laos,patent in fringement is a common problem.At present,the rear estillmany problems in intellectual property protection and patent infringement compensation in Laos.This study is based on the issue of compensation for infringement in Laos,drawing on the compensation standards for patent infringement in the United States,Germany,Japan and China,and studying the current situation of the legal provisions and implementation of compensation liability for patent infringement in Laos.Through research,it is found that the rearefour level problems in the implementation of the patent infringement compensation law in Laos,including time limited abuse of the patent infringement compensation law,insufficient influence of the patent infringement compensation law on the willingness to compensate,deviation of the patent infringement compensation law on the compensation plan,and lack of supervision over the implementation of the patent infringement compensation law.Inview of the current problems,specific ways to improve the implement ationeffect of the patent infringement compensation law in Laos are proposed,That is to strengthen the training of professional sinimplement in patent infringement in Laos,amend the current law based on patent infringement cases,improve the popularity of the patent infringement compensation law,and implement the four measures and suggestions of Laoguo patent infringement supervision with advanced equipment and technology,hoping to help the Laotian government solve the problems in the implementation of the patent infringement compensation law inatimely manner,and improve the protection level of the patent rights and interests of the Laotian government.It is hoped that this can improve the application effect of Laos patent infringement compensation law and protect the right of patent owner to apply.
