Research On Local Practice And Standardization Of Credit Commitment System

Based on the overall background of the construction of social credit system,the credit commitment system,which is supposed to push forward the reform of“Lenient and strict management” and deepen the reform of“Letting go of control and serving”,has been perfected and popularized to a certain extent in the practice all over the country.The implementation of the credit commitment system strengthens the supervision of the market supervision system after the fact,and strengthens the different credit subjects’ awareness of good faith and credit responsibility.However,the credit commitment system,has been strengthened with the acceleration of the construction of the credit society and the strengthening of the state’s attention to the credit regulation,it is worth thinking deeply how to fit in with the credit rule of law and play its due role.In the process of the credit commitment system spreading from local or single department to the whole country,from simple informed commitment system to six kinds of credit commitment system,some problems are also fully exposed.As a new regulatory model and credit system which is still being groped,the concept,legal attribute and practical effect of the credit commitment are still confused,and the system itself lacks a practical and effective normative basis,it leads to the confusion of credit commitment in the process of practice.The system of credit commitment itself needs to be clarified from the theoretical level,and combined with the existing practice and problems to improve the standard construction of credit commitment and system supply.This paper mainly analyzes and discusses the credit commitment system from a theoretical perspective.Firstly,it clarifies the concept of credit commitment.Under the background of the construction of the social credit system,the "credit commitment" is defined as the commitment made by the credit subject to its own credit status,the authenticity of the information or materials provided,and whether to implement or not to implement a certain behavior in the future.Then,from the perspective of public law and private law,it proves that its legal attribute belongs to the administrative agreement and unilateral promise,and further explains the role of the credit commitment mechanism in optimizing the operation mechanism of administrative examination and approval,protecting and stimulating the vitality of market subjects,strengthening the supervision of the market system during and after the event,and strengthening the awareness of good faith and credit responsibility of different subjects.Under the further guidance of theory,this paper understands and analyzes the current legislative situation,type division,field division and system characteristics of China’s existing credit commitment,and finds that although China’s credit commitment construction has achieved certain results,the problems are prominent,especially the weak support of the credit commitment system and the lack of overall planning and systematicness,the lack of the credit responsibility system,as well as The lack of standardization in the implementation and publicity of credit commitments is particularly obvious.In order to standardize the credit commitment system,we need to strengthen the top-level legislative design,formulate special measures for the implementation of the credit commitment system,and accumulate working experience on this basis to prepare for the unified legislative regulation.Besides,it is necessary to clarify the credit responsibility and enhance the binding force of credit commitment.We need to strengthen platform construction and create a pattern of supervision and co-governance.Also,improving the sanctions mechanism for violating credit commitments is indispensable.Finally,we need to further open the situation of the whole society cooperating to carry out the credit commitment system.Let the As a result,the credit commitment system can form a good situation with complete laws to follow,strict procedures,clear responsibilities and perfect supporting facilities in the process of promotion and practice,the credit commitment system can be helpful in the process of China’s system reform,economic transformation and market economy construction,and promote the further development of the construction of social credit system.
