In the context of the separation of the three rights,in order to promote the development of multiple rural businesses and alleviate the problems of fragmented land management in rural areas,land can be transferred and land resources revitalised by means of land management rights into shares.This is a new way for farmers to increase their income and is conducive to the high-quality development of agriculture.This paper takes Huainan County of Heilongjiang Province,Tonglu County of Zhejiang Province and Qingzhou City of Shandong Province as examples.The three countries provide practical experiences of land management rights into companies,cooperatives and first into cooperatives and then into companies respectively,and on the basis of studying and drawing on the research results of scholars at home and abroad,we obtain information and data on land management rights into shares by reviewing literature and issuing questionnaires to understand the The study also analyses the useful attempts and legal problems of land management rights in China,and finally puts forward countermeasures and suggestions.The introductory part introduces the background and purpose of the study,the significance of the study,the review of the study,and the content and method of the study,etc.Scholars at home and abroad have no objection to the possibility of increasing farmers’ income by means of land transfer,but there is a great controversy over the object and nature of land management rights into shares;the second part mainly uses the method of legal hermeneutics to explain the definition of concepts and theoretical basis related to land management rights into shares,with the law The second part uses legal hermeneutics to explain the definition of concepts and the theoretical basis of land management rights,based on the law,to provide legal basis and theoretical support for land management rights into cooperatives and companies,and to implement the theory of property rights,the theory of social equity and the theory of social benefits in the process of land management rights into shares,as social equity is an issue that cannot be avoided in any era,and land management rights into shares is conducive to promoting social equity and improving social benefits;secondly,it introduces the specific practices in practice after land management rights into companies and cooperatives.Then,it summarizes the legal problems that exist in the process of land management rights’ shareholding,such as imperfect evaluation and valuation mechanism,irregular income distribution system,inadequate risk-sharing mechanism and poor withdrawal channels,etc.Finally,it puts forward perfect countermeasures in response to the legal problems.This paper focuses on how to construct a scientific valuation system for land management rights,diversify the distribution of income,improve the risk-sharing mechanism and perfect the withdrawal channels.As for the legal problems of land management rights in practice,the author believes that they can be solved by means of futures in the countryside,clear valuation standards,setting up preferred shares when distributing profits,introducing agricultural professional managers,adding agricultural insurance,broadening financing channels and regulating the buy-back system of land management rights.
