Under the background of the "One Belt,One Road" initiative,Chinese enterprises have gone global one after another,and many problems have also appeared in the process of foreign investment and operation and management.Among these problems,labor legal risks are very prominent,which should arouse the attention of Chinese enterprises.As an important destination for Chinese enterprises to invest in Africa,Zambia has a large and representative investment stock,and it is of great practical significance to study its labor legal risks.This article mainly discusses how Chinese enterprises can take effective ways to prevent and avoid labor legal risks,reduce illegal costs,and maximize corporate interests in the process of investment management and operation in Zambia.The first part is a general introduction to the investment environment of Zambia,mainly including the unique advantages of Zambia for Chinese enterprises to choose investment,and the need for large-scale investment due to the protection of citizens’ employment rights in Zambia and the diversified development of Chinese enterprises’ investment fields.The localization of employment has caused labor disputes.The second part firstly defines the meaning of labor legal risk.Labor legal risk is the risk encountered when violating local labor laws and suffering legal consequences.Then,based on the analysis and summary of the current situation of investment losses of Chinese enterprises in Zambia,four main labor legal risks are extracted: collective bargaining by trade unions,recruitment and employment,wage system and rest right system.A detailed introduction to the local legal regulations and practices in Zambia involved in the labor legal risks in these four areas,and analyzes the differences in labor legal regulations and practices between China and Zambia in these four areas,as well as the differences caused by the differences.Labor law risks.In the third part,in view of the labor legal risks extracted in the second part,combined with the historical experience of Chinese enterprises in Zambia’s investment management,and the practice of correctly handling labor disputes in other countries,it proposes operable risk prevention measures.In general,if Chinese companies investing in Zambia want to effectively prevent labor legal risks,they must clearly recognize the differences in labor laws and practices between China and Zambia at the first level,and must not use domestic management.Habits,but to strictly abide by local laws and regulations,and use local laws to safeguard the interests of the company itself.However,Chinese companies cannot just solve all problems within the legal framework.The essence of labor relations is "people-oriented".Therefore,Chinese companies must actively fulfill their social responsibilities,respect the local work culture,protect the legitimate rights and interests of laborers,and show good companies to the world.image,to achieve a win-win situation between the profitability of Chinese enterprises and the healthy development of Zambian society.
