Study On The Problems And Coutermeasures Of Public Participation In Administrative Decision-making Of County Government

Entering into a new era of socialism with Chinese characteristics,China has put forward new requirements for the construction of a law-based and service-oriented government.As an important theoretical basis for the future development of government,research on public participation in government administrative decisionmaking will play a key role in the modernization of government governance capacity in China.At present,the research on public participation in government administrative decision-making in China follows the principle of encouraging local characteristic innovation and summarizing experience for the central government,so the central government’s institutional planning of public participation in administrative decision-making relies on the subjective initiative of local governments.However,due to the lack of relevant constraints,the administrative “inertia” and“laziness” of local governments lead to the slow progress of the exploration of public participation in administrative decision-making,difficult to meet the realistic needs of the society to advance to a higher level and the awakening of the public’s “master”consciousness.The key to solving the problems of public participation in the administrative decision-making of local governments is to change the administrative decisionmaking concept of local governments,from the traditional “egoism” to “serving the people”.As the subject of administrative decision-making,government occupies an absolutely dominant position in key links such as information disclosure and final decision making in traditional decision-making practice,which makes the public face the dilemma of huge information asymmetry and empty discourse power when participating in administrative decision-making,and finally leads to the process of public participation in government administrative decision-making becomes a mere formality.The Provisions on the Disclosure of Government Information promulgated in 2019,starting from the information disclosure link of public participation in administrative decision-making,positively enumerates the information that must be disclosed in government administrative procedures for the first time.This is a good beginning to gradually change the government administrative decision-making concept by rigid regulations instead of flexible guidance.However,it is far from enough.Public participation in government administrative decision-making involves multiple objects(government,experts,the public)and procedures(early-stage information disclosure,public participation,late-stage information feedback),which requires the government to optimize relevant systems based on the change of administrative concept,to let each object clearly define its own position and make clear the division of responsibilities,neither “malpractice” nor “exceeding duties”,and ensure that all procedures are reasonable,legal,fair and equitable and interlinked.This paper sorted out the relevant theoretical basis of public participation in government administrative decision-making,analyzed the institutional connotation,and demonstrated the rationality and necessity of public participation in administrative decision-making by focusing on county governments with special administrative structure and status,special administrative functions and administrative authority.Through the investigation of the official websites of county-level governments under the administration of C city and interviews with local people,the author found that the practice of public participation in administrative decisionmaking of county-level governments needs to be improved,for it greatly restricts the equality of the status of all participants and the fairness and effectiveness of procedures.On this basis,this paper discussed the realistic difficulties in the practice of public participation in administrative decision-making of county-level governments starting from each participating object and each procedure,and put forward feasible optimization countermeasures to accelerate the local exploration process of public participation in government administrative decision-making.
