Research On "The Paper" Crime News Report From The Perspective Of Constructive News

Crime news report refers to the report of illegal and criminal acts and related phenomena or events that are extremely harmful to society,violate the criminal law and should be punished by the criminal law.Its report object includes the background of criminal acts,court trials,expert interpretation,social consequences and other facts.It has the characteristics of conflict and irritation,and has the functions of enhancing social early warning and disseminating legal knowledge.However,excessive or anomie crime news reports can easily lead to negative effects.Therefore,it is necessary to introduce the concept of Constructive News into crime news reports in order to avoid the negative effects of crime news reports and give full play to their positive functions.This paper adopts the research ideas of theoretical construction,current situation analysis and strategy discussion.Firstly,based on the connotation and core characteristics of Constructive News,combined with the basic content and function of crime news report,this paper constructs an index system to evaluate the "constructive" elements of crime news report.The index system is divided into basic level,key level and expansion level.The basic level includes the elements of “providing case background” and “inclusiveness and diversity”,the key level includes the elements of“problem solving orientation”,“arousing positive emotion” and “popularizing legal knowledge”,and the expansion level includes the elements of “empowerment” and“collaborative innovation”.Secondly,select the news written reports of “the paper”on the top ten criminal cases in 2019 and four of the top ten criminal cases in 2020 selected by the people’s court newspaper as the research samples,and take each report as the analysis unit to analyze the “constructive” elements of the above reports from the perspective of constructive news.The study found that,on the whole,in the crime news reports of “the paper”,the lack of “constructive” elements is mainly reflected in the following aspects: the case background is not comprehensive enough and lacks the macro level background;There is still room for improvement in the diversity of views;Lack of problem-solving orientation,and the discussion of limited solutions is mostly empty;They seldom convey positive emotions and fail to fully arouse the positive emotions of the audience;The function of popularizing legal knowledge is weak;In the information sources,the public voice is weak,the traditional production mode is dominant,and the elements of“empowerment” and “collaborative innovation” are not obvious.The article finds that these problems are related to the lack of Constructive News ideas and legal literacy of journalists,and more restrictions on crime news reporting.Therefore,the article suggests that China’s journalism circles and industry should form a joint force to promote the localized dissemination and practice of constructive journalism ideas;Journalists should actively improve their legal literacy and strengthen the function of law popularization of crime news reports;The news media should actively understand the public’s ideas and guide the public to discuss rationally within the scope permitted by law.
