In recent years,digital economy is improving by leaps and bounds,the size of the Online game market and the user base have grown rapidly.Virtual property disputes in online games are on the rise and gradually become one of the hot issues concerned by the society,which has become one of the hot issues of social concern.The research on virtual property at home and abroad has achieved many results,but it is still in the theoretical research stage,and no state has yet passed legislation to protect virtual property in online games.The first time China’s l aw stipulates virtual property is in the Civil Code,but it does not refine virtual property,it is only a declarative provision for oaths.Because the legislation has not yet clarified the relevant issues,different people do not have a unified opinion on the legal nature of online game virtual property and the choice of protection model,resulting in same case,different verdict.For example,in determining the nature of the game operator’s cessation of operation,some courts have identified it as an online in fringement dispute,holding that the online game operator has infringed on the property rights and interests of the player,while some courts believe that it is a dispute over the network service contract,which is sufficient to resolve the dispute accordi ng to the user agreement,and the court should not interfere.In terms of ownership of rights,in order to protect online virtual property,it is advisable to classify game virtual property as the property rights and interests of players,and it should be found that the act of stopping operations of online game operators constitutes infringement.In addition,when dealing with disputes arising from the suspension of online games,it is inevitable that the issue of compensation standards will be involved,an d there are also very different views in academia and practice,and compensation should be discounted according to the market price.Finally,judicial interpretations should be issued on virtual property to clarify the handling methods and compensation sta ndards for such disputes,regulate the commercial behavior of the upstream and downstream industrial chains of online games,and establish a virtual property appraisal system.After the improvement of China’s virtual property protection system,The handling of legal issues related to the suspension of online games is bound to be clearer.
