Research On International Law Issues In Building A Human Health Communit

Since the outbreak of COVID-19,the global cooperation against the epidemic has gradually attracted the attention of the international community while many countries were controlling the spread of the epidemic,.With the development trend of globalization,the international cooperative system on prevention and control of infectious diseases should be on the basis of further building and perfection of the concept of human health community,if the loopholes of the existing international legal documents and practice of the infectious disease prevention and control are not timely explored and solved,countries around the world will be difficult to form a long-term cooperation mechanism.Therefore,it is benefitial to analyzing the existing problems of international organizations in response to controlling the infectious disease and clearing international law obligations,and it has significant implications on enhancing the efficiency of the members of the international organizations in actions on preventing and controlling infectious disease,and for the countries around the world to be more effective in the future alert and containing the disease threat,at the same time to lay the foundation for reforming international law and the globalization governance system of major infectious disease and the unity of nations on global disease cooperation.In the first part of this paper,the background of international cooperation against COVID-19 is based on the timeline of the incedents of COVID-19,as well as the differences in the choice of governance models of different countries based on the political and cultural background,the reform of the WHO in the global public health governance,the challenges and the reform direction.The second part analyzes the shortcomings of some practical problems in coordination and communication.,through the case of the Diamond Princess international cruise ship.The paper analyzes the policy of the vaccine to emphasize the international public health crisis.The COVID-19 vaccine policy should be strengthened by emphasizing its public product nature.and alleviating the conflict between the nature of public welfare and the protection of private intellectual property rights,and promoting the equitable distribution of public health products,such as vaccines.Given the phenomenon of "additional health measures" taken in the affected countries and regions after the outbreak of COVID-19,countries should pay attention to the application of proportionality principles to avoid creating additional restrictions by analyzing the provisions of travel and trade restrictions.The third part analyzes the problems existing in the international regulatory system in the global cooperation,including the softness of legal documents in the international health field;the national liability system and the dispute settlement mechanism between countries;the fragmentation and overlapping public health legal documents and provisions formulated by international organizations with different functions;and the lack of supervision mechanism on compliance of the member states in the cooperation,the diversified but unclear supervision subjects,and the imcomplication of the legal regulations on international health aid.The fourth part summarizes the background and value of the concept of human health community;under the guidance of the concept of human health community,China improves the domestic legal mechanism coordinated with global health governance in four aspects of infectious disease monitoring and assessment,the verification report,the disposal measures and the right to health protection.Under the guidance of this concept,China promotes the cooperation practice of global health governance,carries out bilateral,multilateral and regional international cooperation and strengthens the legal mechanism of foreign aid.The fifth part addresses the practical problems faced in the global anti-epidemic cooperation and the original problems of international legal regulation,The idea to solve the cooperation dilemma is provided with the goal of building a community of human health,By building a legal coordinating system with practice,we may improve the international health aid,implement the health restriction measure system,incorporate the public health product distribution system,and establish a specific compliance supervision mechanism.Adhere to the World Health Organization as the core of cooperation mechanisms,we may enhance the transparency of WHO work,establish an effective financing and distribution mechanism,enhance the institutional interaction among international organizations to achieve complementary advantages and achieve a multilateral cooperation through regional linkage.We will strive to establish an sustainable international health cooperation and governance mechanism.
