COVID-19 began to influence the world in early 2020,which becomes the most important issue that our world needs to face together nowadays.Since declared as the PHEIC,COVID-19 has a great impact on the WHO,who occupies a major position in global health governance.The legal system of health assistance of the WHO has also exposed its shortcomings in facing COVID-19.The legal system of health assistance of the WHO refers to a health assistance system which mainly focuses on the WHO’s Constitution and the International Health Regulations(2005),then supplemented with some related legal documents.Nowadays,when global relationships are getting closer and the gap between the rich and the poor countries is expanding,the status and role of the legal system of health assistance are becoming more and more important.However,the inherent shortcomings of the legal system of health assistance,as well as the new problems that have emerged in response to various kinds of serious health incidents arising from PHEIC,have indicated the urgency of accelerating the improvement of the health assistance legal system of WHO.This article is mainly divided into fifth parts to analyze the defects of the legal system of health assistance of the WHO from different aspects.On this basis,this article refers to the relevant experience with the purpose to propose some useful strategies to improve the legal system of health assistance.The first part is based on the background of COVID-19 and non-traditional security theory,then combining with the research at home and abroad to show that the research on the legal system of health assistance of the WHO is meaningful.The second part takes the definition and the history of the health assistance activities as the basic part,then combining the relevant era background and the world situation to explain the function of health assistance of WHO.On this basis,the article introduces the legal system of health assistance of WHO in detail,and then analyzes two practical cases based on the current legal system,which paves the way for the indications of the obstacles in practice.The third part mainly analyzes the advantages and limitations of WHO’s legal system of health assistance.The fourth part setting the existing shortcomings of the legal system of health assistance as background,then referring to relevant experience to propose available measures to improve the legal system of health assistance.The fifth part takes the participation of China in WHO health assistance as the beginning,then based on the existing shortcomings in participation,the article offers some available suggestions so that the operation of international health assistance can be more effective with the participation of China.
