Research On The Functions Of Township Judicial Offices From The Perspective Of Grassroots Governanc

Socialism with Chinese characteristics has entered a new era,rural society has ushered in development opportunities,and the social structure has undergone profound changes.In recent years,the state has attached special importance to grassroots social governance,township judicial institutes,as the national grassroots judicial administrative organization,the most basic tentacles of state power to control social forces,have played a pioneer role in the tide of "sending the law to the countryside",in the face of new problems in the countryside,township judicial institutes have risen to the challenge,using their flexibility,initiative and rich local resources,giving full play to their own functions,avoiding disadvantages,improving themselves,and providing a stable social foundation for grassroots governance contributions.There are five chapters in this article.First of all,it is an introduction,which mainly introduces the research background of township judicial institutes,the current research status at home and abroad,as well as the research difficulties and research situation.First of all,it is clear that China’s rural changes have put forward higher requirements for township judicial offices,which is both a tribulation and an opportunity;Secondly,it is proposed that the study of judicial institutes should be placed from the perspective of grassroots governance,which is more conducive to the positioning of townships and towns,highlighting their value.Finally,the major difficulties of this study are shown,and the investigation of township judicial institutes is carried out to provide empirical data for this study.Chapter 1 first introduces the concept and nature of township judicial offices,and clarifies that judicial offices have both judicial and administrative attributes;Secondly,from the beginning of its establishment to today,each step of the development of the judicial institute has been adjusted according to social changes and has strong adaptability;Finally,the basic concepts of grassroots social governance are introduced,the construction of rule of law is implemented at the grassroots level,and the two rural judicial models of "rule of law theory" and "governance theory" are analyzed,so as to help the grassroots social governance system and governance capacity building.Chapter II analyzes the ways in which township judicial offices participate in grassroots governance,relying on their functions,and dividing them into participating in mediation of disputes,criminal enforcement,providing legal services,and providing auxiliary assistance.Chapter 3 introduces the role of township judicial institutes in grassroots social governance,clarifying that it is conducive to promoting the construction of rural rule of law and helping the state formulate laws at the grassroots level;Improve dispute resolution mechanisms,resolve rural conflicts and disputes,and save judicial resources;Maintain the stability of rural social order and provide a stable environment for rural economic development and people’s good life;At the same time,it can provide free legal services to solve some rural people’s litigation problems.Chapter 4 first finds that in the process of performing their functions,township judicial offices have low working capacity,limited functions,insufficient understanding of grassroots governance,and cannot well understand the combination of "autonomy,rule of law,and rule by ethics",and difficulties in reaching the grassroots level of township judicial offices.Then,the existing problems are analyzed,and the reasons are explored in combination with the development of the judicial institute and social changes.Chapter 5 is to strengthen the functions of township judicial offices and improve the grassroots governance capacity of township judicial offices,which is the purpose of this article.Analyze the research situation and literature,find problems,propose solutions,and try to promote the development of practice through academic research.First of all,township judicial offices should improve the management system,improve the quality of staff,standardize work,and improve work ability;Second,clarify the goal of combining "autonomy,rule of law,and rule by ethics",and improve the service capacity and level of township judicial offices;Finally,promote the deepening of township judicial offices to the grassroots level,strengthen ties with the grassroots people,and promote the construction of grassroots social governance.
