In recent years,China has vigorously promoted the construction of information standardization systems such as Internet plus+medical care,the construction of national unified electronic health records,and electronic medical records,and gradually achieved the goal of all in one network,online and offline access,and information exchange and sharing between medical institutions and enterprises.With the advent of the era of accurate collection and sharing of personal health information,information processors hope to obtain more information in the process of collecting,analyzing,and using personal data to explore and realize its value,bringing potential risk of rights and interests infringement to the originators of personal health information.At the same time,different application scenarios involve different types of personal health information,information stakeholders,and corresponding personal health information protection points and measures.What standards and rules should be adhered to in handling and protecting these personal health information are facing challenges of the times.Based on the practice of the "Personal Information Protection Law" and relying on the "Civil Code",the opening chapter elaborates on the policy support and new requirements of the medical sharing cause,and proposes that the sharing of personal health information is the most important mobile factor in achieving the sharing of medical resources.After analyzing the content and characteristics of personal health information and personal information,it is found that personal health information itself has three characteristics that are different from personal information,namely,high sensitivity,multi-level nature,and weak subject control.Based on the Citespace software,this paper studies the hot and difficult issues in the protection of personal health information under current medical sharing,proposes three practical issues in the field of personal health information: laws and regulations,multi-level protection system,and rights and responsibilities rules that need to be addressed,and analyzes the reasons for the above issues in depth.Then,using the method of comparative analysis,we seek solutions to the problem from outside the region,combining the experiences of the United States,the European Union,and Japan with our basic national conditions to draw inspiration and reference.Finally,based on the previous article,targeted suggestions for improving the protection of personal health information under medical sharing in China are proposed: the issue of personal health information protection under medical sharing cannot be ignored,and appropriate systems and mechanisms need to be formulated on the basis of clear legislation.By establishing a multiple information notification system and a punitive compensation mechanism in the specialized legislation on personal health information,supplemented by a multi-level dynamic identification,authorization,and informed consent system for personal health information,a new pattern of personal health information rights and responsibilities system is constructed,and the new requirements of the new stage of medical sharing are targeted.
