Research On Blockchain Storage Of Electronic Data

Because of its easy to be tampered with,electronic data has a low acceptance rate in judicial practice.The rise of blockchain technology has broken the dilemma of the application of traditional electronic evidence,but as a new depository technology,there is still room for improvement in the guarantee mechanism integrated with law.Based on the basic principle of blockchain depository,this paper analyzes the advantages of blockchain of technology in judicial application,and gets its necessity and feasibility in electronic data depository.Three typical cases can be used as a breakthrough point to find the main problems existing in blockchain storage.It mainly focuses on legislation,the depository platform and justice.From the perspective of legislation,China’s legal norms on the blockchain certificate storage technology are not perfect,lack of specialized laws and regulations,dispute over whether the electronic data through blockchain certificate belongs to the original or copy,and lack of unified national and industrial standards on blockchain of technology.In terms of the depositary platform,there is no clear distinction between the judicial alliance chain and the third-party depositary platform,and the third-party depositary platform lacks unified and specific platform qualification examination standards and effective supervision.In terms of justice,it is difficult to guarantee the authenticity of electronic data before it is connected to the chain,the electronic data stored by blockchain technology does not play its advantage of technical self-certification,and the examination subject has insufficient knowledge of blockchain.In order to solve the problems in blockchain depositing,suggestions are put forward from three perspectives: perfecting legislation,third-party depositing platform and judicial application.In terms of legislation,relevant laws and regulations should be improved,electronic data original review rules should be established,and technical specifications and standards of blockchain depository platform should be perfected to provide a legal basis for the use of blockchain technology.In terms of platform specification,judicial alliance chain and third-party depository platform shall be examined in different ways,qualification standards of blockchain depository platform shall be clarified,and effective supervision of third-party depository platform shall be strengthened.In terms of judicial application of blockchain certificate,the authenticity of electronic data generated under the chain is guaranteed,a duality perspective of electronic data blockchain certificate review is formed,and compound legal talents are cultivated.
