With the rise of digital revolution and the rapid development of smart society,the modernization process of national governance system and governance capacity under strong push has been endowed with the dual orientation of "ultra-modernity".Virtual-reality isomorphism,human-computer intelligent interaction,and digital ecological reconstruction is the biggest characteristic of the digital-intelligence era.At the same time,our country is experiencing a social transformation from "post-industrial civilization" to "digital civilization".This social transformation not only means the macro reform at the institutional level,but also implies the micro evolution of basic rights,among which one of the most influential basic rights is the right to education.Since modern times,"education" has always been the foundation of the power to advance a nation and affect the long-term stability of the country.As an emerging media power,intelligent technology in the digital age enriches the form of citizen education,breaks through the limitation of time and space,and successfully realizes the leap from physical media teaching to virtual media education.Facing the interweaving of the dual space of education,the research on the protection of citizens’ digital right to education is extremely important.At present,the analysis and research on the traditional mode of protecting the right to education mainly focus on clarifying the object of protection,the standard system of protection and the subject of power implementation.This thesis tries to analyze and expound the theory of digital education governance from the perspective of combining the era background with the right to education.From the macro dimension,the protection of the right to education is the manifestation of digital governance in the field of education.From the micro dimension,the protection of the right to education also reflects the concern for citizens’ enjoyment of basic human rights.In the context of the intelligent age,the protection of the right to education presents new changes different from the traditional period.First,digitalization has formed the value concept of a balance between technology empowerment and the right and obligation to education,a new decentralized system architecture and a platform-led educational governance model.Secondly,digitalization creates the logic of digital education governance,such as the order form of calculation decision-making and code regulation,which promotes the transformation of the educational rule of law in the digital era,and produces the educational rule of law principle of co-construction and sharing and the operating mechanism of intelligent governance.In addition,digital algorithms bring both opportunities and challenges to the protection of the right to education.On the one hand,it gradually disintegrates the traditional power system,promotes the power system to evolve from state dominance to pluralism,and guides the private power subject--digital education platform onto the historical stage as an independent educational governance force,thus forming an educational governance structure with checks and balances among the state,society and platform.On the other hand,digital algorithms also bring challenges to educational governance and the protection of citizens’ right to education.For example,the traditional education guarantee model cannot meet the requirements of digital governance;Under the digital environment,the state as the main body to guarantee the right to education has shortcomings and deficiencies.The traditional one-way guarantee method has defects.It is urgent to solve many problems such as the limited physical space of traditional security and the unclear information of traditional security which can not realize digital justice.In view of the problems facing the protection of the right to education in the digital age,based on the analysis framework of the dual nature of the right to education,this thesis makes an in-depth discussion on the digital legal issues of the protection of citizens’ right to education from the perspectives of subjective rights and objective law.The thesis establishes that the core of the protection of the right to education in the digital era lies in the clear relationship between the traditional rule of law and the digital environment,and discusses the protection of the right to education in the digital environment from the macro to the micro perspective,with the focus on the digital education governance.It needs to be understood that digital rule of law has promoted the updating of the mode of protecting citizens’ right to education,realizing the transformation of the mode from state-led to co-construction,sharing and co-governance,one-way to three-way and multi-dimensional,and hierarchical to smart governance.This thesis finds that,in view of the prominent problems faced by digital education governance,the protection of citizens’ right to education in the digital era should first take co-construction and sharing as the core concept of education governance,then take the wisdom model as the way and means of governance,and again break the one-way guarantee way and broaden it to a multi-dimensional subject parallel system.Finally,digital justice is taken as the primary value target of educational governance.Only in this way can the traditional right to education protection break through the barriers of outdated thinking and realize the maximum value of digital education governance.
