communication and integration in the historical process of thousands of years.Since the beginning of the new era,General Secretary Xi Jinping has publicly mentioned "building a strong sense of community of the Chinese nation" at many important meetings and occasions.This shows that building a strong sense of community of the Chinese nation is an important component of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era and a guide to action for the Party and the state to carry out ethnic work in the new era.Local legislation on ethnic unity and progress,as a special legislation regulating and guaranteeing ethnic unity and progress,helps to provide important guarantee and institutional support for all regions to forge a strong sense of community of the Chinese nation.Starting from the current 26 local legislation of ethnic unity and progress,this paper studies the legal construction of ethnic unity under the consciousness of building a strong Community of The Chinese nation.Local legislation on ethnic unity and progress,as a special legislation regulating the creation of local ethnic unity and progress,has a strong pioneering and creative nature.By clarifying the responsibilities of state organs and social subjects,it helps to build a strong sense of community of the Chinese nation in the whole society and promote the effective implementation of ethnic policies in ethnic areas.It is of great significance to promote the coordinated development of regional economy and protect the equal rights and interests of citizens of all ethnic groups.The formulation of local legislation for ethnic unity and progress is based not only on the complex situation at home and abroad,but also on a series of theoretical guidelines and measures proposed by the Party and the state.At the same time,domestic laws represented by the Constitution,The Law on Regional Ethnic Autonomy and the Legislation Law,as well as international laws represented by the International Charter of Human Rights and the Charter of the United Nations have also provided an important legal basis for the enactment of local legislation on ethnic unity and sets "solidifying the sense of community of the Chinese nation" as the legislative purpose in the general provisions.Although the relevant words in a few legislation appear many times,they are mainly reflected in a few areas such as publicity,education and cadre training.Therefore,it can be concluded that the local legislation for ethnic unity and progress has problems such as insufficient coverage,insufficient consciousness of building a solid Community of the Chinese nation,lack of ethnic and local characteristics,single form of social participation,low quality of legislation,imperfect implementation supervision and legal protection,etc.As well as the lag in legislative activities,the convergence in the development of ethnic regions,the restrictions on the professional level of local legislation and other problems.Under the background of the comprehensive rule of law,we should further improve the legal construction of ethnic unity and progress,and promote the development and improvement of local legislation on unity and progress centering on "building a strong sense of community of the Chinese nation".Through innovative means,based on local conditions,and strengthening social participation mechanisms,we ensured that the spirit of The Times--"to forge a strong sense of community among the Chinese nation"--was implemented in detail in activities to promote ethnic unity and progress.Local legislatures should pay attention to promoting the transformation of the party and state ethnic policies into legal texts,and promote the flow of excellent legislative personnel in the province through rational arrangement of legislative text structure and various forms,so as to improve the quality and level of local legislation for ethnic unity and progress.At the same time,it is necessary to gradually improve the supervision and accountability mechanism for the implementation of ethnic unity and progress in an all-round way. |
