Judicial committee is an important part of China’s judicial practice and a judicial system with Chinese characteristics established under the leadership of the Communist Party of China.The system has been in operation for more than 70 years in China’s judicial system,and has made great contributions to the reform of China’s judicial system and the progress and improvement of the judicial system.The system itself has also carried great historical value.The system itself also has a certain historical origin and tradition,but gold is not perfect,jade has a slight flaw.With the development of the modern judicial system and the introduction of the Western concept of procedural justice,there are indeed some inconsistencies in the judicial committee system with the current concept of criminal procedure,and with the deepening of practice,many problems have also been shown Therefore,the doubts and disputes about the judicial committee system have never stopped.More and more scholars have put forward their own views on the judicial committee system.Some people argue that the judicial committee system conforms to the reality of China,has a certain historical tradition,and should be maintained and improved continuously.Some people think that the judicial committee system has played a great role in the history,but with the progress of the country’s legal work,the judicial committee system has lost its existence of the "social soil".In view of the existence of the judicial committee,the author also expressed his own views in the article.However,in the long-term operation of the judicial committee system,it does expose some problems that need to be solved,such as the strong administrative color of the operation of the judicial committee system,the risk of infringement of the litigant’s litigation rights and interests in the process of the criminal case trial function,some factors do not conform to the modern judicial concept and the lack of differentiation of the functional reform of the judicial committee.In view of these problems,the paper puts forward its own suggestions to revise and improve the judicial committee system,to revise the system itself,to dilute its administrative color,to take the "elitist road" of the judicial committee,and to improve the working mechanism of the judicial committee.This paper puts forward the vision of the judicial system reform in the future.It not only implements the differentiated function reform plan of the judicial committee according to the localization characteristics.
