On The Social Responsibility Of Lawyer

At the end of 2010,the Beijing Lawyers Association released the first social responsibility report of the lawyers’ industry in China,which aroused the concern of the industry about lawyers’ social responsibility.In July 2019,the General Offices of the CPC Central Committee and The State Council issued the Opinions on Accelerating the Construction of a Public Legal Service System to further give play to the role of lawyers in the construction of a public legal service system.In October 2019,the Ministry of Justice issued the Notice "Opinions on Promoting Lawyers’ Participation in Public Interest Legal Services",which provides further guidance for lawyers’ participation in public interest.Whether participating in the construction of the public legal service system or participating in social welfare,it is an embodiment of lawyers’ social responsibility.With the continuous development and growth of lawyers’ professional groups,lawyers are playing an increasingly important role in social life,and the assumption of lawyers’ social responsibilities is also attracting more and more attention.However,there are not many studies on lawyers’ social responsibility in the theoretical circle,and the social responsibility of lawyers is not clearly stipulated in the legislation,which leads to the low consciousness and enthusiasm of lawyers to undertake social responsibility in practice,and even evasion and refusal of lawyers to undertake social responsibility.This not only affects the overall image of lawyers,but also reduces the public’s evaluation of lawyers.In the long run,It is also detrimental to the long-term development of the profession.This paper starts with the meaning of "responsibility" and "social responsibility",and on the basis of summarizing and analyzing the previous definition of lawyers’ social responsibility,proposes that lawyers’ social responsibility refers to the legal and moral obligations that lawyers undertake for the realization of the parties and social public interests by using their professional legal knowledge and skills under the premise of safeguarding the legal rights and interests of the parties.Lawyer society responsibility is a relatively grand narrative.The author takes the different roles played by lawyers in social life as the entry point,and from the three aspects of lawyers as agents of litigants,rule of law workers and special citizens mastering professional legal knowledge,further divides the specific content of lawyers’ social responsibility into safeguarding the legitimate rights and interests of litigants and promoting the perfection of the legal system.We will ensure the correct implementation of the law,safeguard social fairness and justice,carry out publicity and education on the rule of law,and improve public welfare.Based on the analysis of the present situation of the lawyer’s social responsibility in our country,analyzes the obstacles in the process of realizing the lawyer’s social responsibility,put the final point on how to overcome these obstacles,make the lawyer group to bear social responsibility way,based on the national conditions of our country,learn from foreign practical experience,the targeted countermeasures to promote the lawyer consciously bear social responsibility: Start from lawyers themselves--lawyers themselves should pay attention to improving professional quality;Perfecting the system construction of lawyers’ social responsibility--enforcing,encouraging and guaranteeing lawyers’ social responsibility from the system level;Perfecting lawyers’ culture--bringing lawyers’ social responsibility into the scope of lawyers’ cultural construction,providing guidance for lawyers’ social responsibility in practice.
