Modern human civilization is in the midst of a highly unstable "Risk Society",and labor,an important basic human activity,is facing increasingly complex and unpredictable risks of modernity.The modern industrial system has created uncontrollable technological risks,and the rapid transformation of labor patterns and the disintegration of standardization have brought new challenges to labor security.As the most important means of realizing the social value of labor,the state obligation to pay for labor rights must assume the responsibility of preventing and controlling the risks of labor rights within the framework of the rule of law.The modernization process in the risk society has triggered the change and transformation of the social system,and the mechanism of risk distribution and action has become an important influencing factor in the construction of the system.In order to better achieve the goal of guaranteeing the right to labor rights by the state,it is necessary to combine the theoretical structure of the "risk society" with the current system of state payment of labor rights in China,introduce the modern characteristics of risk to analyze the problems faced by the protection of labor rights,and build a long-term and feasible risk management mechanism.In the risk society,the labor rights system is facing an unprecedented crisis.The modern endogenous uncontrollable decision-making leads to the creation of risks,the diffusion effect of risk elements makes risks cross geographical and social boundaries,and the de-standardization of the labor system makes the traditional protection model ineffective.The state payment of labor rights has a specific function of risk control and relief in a risky environment,but attention should be paid to the risks inherent in its means and the necessary realistic limits.The social value of the obligation to pay labor rights in risky societies is more prominent,as the fulfillment of the obligation to pay provides a bottom line for the survival of social groups in risky environments,enhances the risk prevention ability of individual citizens,and helps to achieve the goal of social justice.In recent years,through the construction of the labor security system,China has made certain achievements in the state payment of labor rights in three aspects: material,procedural and service.However,due to the typical post-modern factors in the current risk society,the state payment of labor rights also faces some realistic dilemmas,and the current institutional system has shortcomings,and the state payment of labor rights in the risk society needs further improvement.The current system is flawed,and the state payment of labor rights in risk society needs further improvement.At present,a social sharing mechanism of labor rights risks should be constructed,and the whole society should participate in the sharing of systemic risks.The legislation on the guarantee of labor rights state benefits needs to be improved in terms of content and procedures,and special social assistance legislation for risk society should be promoted.The means of labor state benefits need to be further optimized on the basis of subsistence,and gradually move towards the goal of social promotion in a three-dimensional level of benefits.
