With the development of science and technology,automation technology has penetrated into many fields of life and is applicable to various aspects of administrative governance,such as administrative penalties,administrative licensing,etc.,promoting accurate and effective administrative management,and promoting efficient and convenient administrative management.Coexisting with various advantages brought by automated administration are various legal risks that arise simultaneously during the development of automated administration.As a new administrative technology,automated administration inevitably has a mismatch with traditional administrative legal regulation systems.Clearly studying the legal regulations of automated administration is the need for building a government governed by law and a service-oriented government.We must carefully analyze the risks and challenges brought about by automated administration,explore the reasons for their occurrence,and the ultimate goal is to integrate automated administration into the orbit of the rule of law,thereby solving the problems existing in automated administrative behavior.This article is divided into three parts:The first part is a summary of the theoretical basis of automated administration.Clarify that automated administration refers to administrative actions performed by automated equipment instead of manual labor.By differentiating and analyzing the concept of automated administration,further analyzing the characteristics of automated administration,and clarifying the advantages and uniqueness of automated administration.By discussing the necessity,this article clarifies the significance and value of legal regulation of automated administration,and clarifies that the study of legal regulation of automated administration is necessary to serve the construction of a government ruled by law and a service-oriented government.At this stage,relatively backward and scattered laws are difficult to regulate the newly emerging automated administration,indicating that automated administration has put forward new requirements in the current field of administrative legislation.The second part discusses the risks and challenges that automation brings to legal administration.By analyzing many risk patterns in the application of automation in practice,for example,there are different risk issues in traditional responsibility attribution,personal information protection,administrative counterpart procedural rights,and relief approaches in automated administration.Multiple subjects make it difficult to identify the responsible subjects;Automation itself has technical risks such as algorithmic data;The lack of automated procedural justice has led to the reduction of the procedural rights of the counterpart;Intensive monitoring and data collection continue to squeeze the space for public and personal information rights and interests;The lack of supervision is also an objective problem.The third part proposes solutions to the existing problems in automated administration,and proposes to clarify the subject and responsibility of automated administration in response to the impact of automated administration on traditional accountability principles;Improve data and information protection by protecting citizen information;In the part of safeguarding the procedural rights of the administrative counterpart,two solutions are proposed:strengthening the responsibilities of administrative organs for procedural correction,and clarifying the procedural requirements that automated administration should meet;Finally,improve administrative governance and promote the development of automated administration by clarifying relief channels.
