Education is the foundation of a century-long plan.Private education and family education in our country continue to develop.And there have been widely controversial cases.All these cases show the conflict between education rights in contemporary China,and more specifically,the conflict between public power and private rights in education in contemporary China.This paper mainly uses literature analysis,comparative research,historical research,case study and other methods to carry out research.It is divided into five chapters.The first chapter is the analysis of the relevant concepts of educative power;The second chapter explores the current situation of the exercise of the educative power in contemporary China from legislation,judicature and administration,and evaluates the existing problems of the educative power in contemporary China;The third chapter summarizes the characteristics of educative power in contemporary China;The forth chapter mainly discusses the causes and justifications of the characteristics of the educative power in contemporary China;The fifth chapter evaluates the manifestation of the conflict between the public power and the private right to education and the reasons for the public power,carries on the constitutional review.
