| China’s legal aid system started late and has been gradually improved in recent years,but there are still some shortcomings,especially the legal aid for rural areas.On January 1,2022,China’s first the legal aid law of the People’s Republic of China began,coupled with the gap between urban and rural population in recent years,however,the rural population is still large,especially in recent years,countries more and more attention to rural development and construction,the new rural construction and urban and rural overall development strategy steadily push forward,the legal consciousness of farmers,farmers’ demand for rural legal aid system is more and bigger.Therefore,in order to better protect the legal rights and interests of farmers,efficiently solve the disputes between farmers,promote the development of rural economy and mediate the social relations between farmers,the academic circle has gradually studied the rural legal aid system in China.However,there are still some problems to be solved in the practice of rural legal aid system in China,such as shortage of funds,uneven distribution of legal aid work institutions and personnel resources,and imperfect infrastructure.Therefore for the convenience of the investigation,to better understand the running status of the rural legal aid system,especially the economic underdeveloped western minority mountainous area,the author in the western minority settlements,select his hometown as the survey object,through the questionnaire to local farmers,interview related personnel to investigation of local rural legal aid work practice,to understand the problems of the rural legal aid system and analyze its causes,finally put forward solutions.This paper is divided into three chapters,Chapter 1 is an overview of the rural legal aid system,Mainly expounds the theoretical knowledge of legal aid system and rural legal aid system,And compare and analyze the operation of the legal aid system inside and outside the domain;The second chapter is the practical investigation and analysis of China’s rural legal aid system,Taking Maoxian County of Sichuan Province as a survey sample,By interviewing local legal aid workers,lawyers and township mediators,And conducting a questionnaire survey of local farmers,To understand the basic situation of rural legal aid work,the types and solutions of rural disputes,and the farmers’ understanding of the legal aid system,Based on the above data,analyze the problems and causes of China’s rural legal aid system;Chapter three is the proposal for improving the rural legal aid system,Combined with the achievements of China’s legal aid work for farmers,Comprehensive evaluation of the rural legal aid system,In combination with the previous article,In view of the urgent problems to be solved in the rural legal aid system in China,the corresponding suggestions are put forward. |
