Rearch On Local Legistation Characteristics Of Districted Cities

According to the Constitution and the Legislation Law,China has established a legislative system of "one yuan,two levels and multiple levels" to ensure that local governments can provide full play to their propose and zeal under the centralized guidance of the central authority.Local legislation mainly started from the reform and opening up,and has gone through a development process from nothing to exist and from less to more.It can be said that empowering local legislation is an important institutional arrangement for the way of national governance.As an important part of the socialist legal system with Chinese characteristics,local legislation provides a legal basis for local governance.The original purpose of granting local legislative power is to comprehensively promote law-based governance and modernize China’s governance system and capacity.Local legislation provides effective basis for local affairs management,combines with local reality,makes local governance more targeted,in order to make up for the central legislation on local affairs management of the principle of legislation produced by the deficiency.Local legislation is mainly tailored to local conditions,with local characteristics,meets the overall requirements for comprehensively advancing the rule of law,and enriches the socialist system of laws with Chinese characteristics.From the perspective of local laws and regulations of cities divided into districts,this paper analyzes the current situation,existing problems and causes of local legislative characteristics through sorting out theoretical problems and empirical research,and then puts forward specific countermeasures to enhance the local legislative characteristics of cities divided into districts.The article is be split into five section:The first part is the introduction,which mainly introduces the research background,research significance,research ideas and innovation of local legislation characteristics.The second part is the theoretical analysis of the research on the local legislative characteristics of the city divided into districts.It first expounds the evolution of local legislative power,the division of local legislative power and the local legislation of the city divided into districts from three aspects,and then analyzes the connotation,origin,boundary and practical significance of the local legislative characteristics.The third part is normative analysis,expounds the reasons for sample selection,and analyzes the local characteristics of historical and cultural protection laws and regulations in cities divided into districts in Sichuan Province from the legislative style structure and specific content clauses.The fourth part is the analysis of the existing problems and their causes.It thinks that there are some problems such as the legislative style structure convergence and the single administrative punishment means.The main reasons are the fuzzy standard of the central and local legislative authority division,the deviation of the legislative workers’ understanding of the principle of "non-conflict",and the stereotyped tendency of the local legislative style structure.The fifth part is the countermeasures and Suggestions,try from such aspects as system,method,subject puts forward some countermeasures to enhance the characteristics of local legislation,in order to reveal more local characteristics in local legislation,further enhance the local legislation operability,and comprehensively promote the rule of law,realize national modernization management system and management ability,increase social governance efficiency.
