Research On The System Of Class Case Retrieval In China

As one of the important systems in the process of judicial reform,the existence of the class case search system effectively improves the accuracy and standardization of class case adjudication,and also can effectively alleviate the differences and discrepancies in the adjudication process and improve the efficiency and level of judicial adjudication in China.However,in terms of the current use of case search,it is obvious that the advantages of the case search system have not been effectively played,showing an embarrassing situation of insufficient intelligence and poor user experience,which directly affects the realization of the purpose of the case search system and the full implementation of the case search system.This paper uses the research method combining theory and practice,and divides the case search system into case search and identification,case understanding and application,and case supervision and relief by sorting out the normative documents issued by the Supreme People’s Court related to the case search system.By systematically analyzing the current situation of the class search system in Sichuan Province according to the operation of the class search system,we discover the specific difficulties of the system,explore the reasons behind the difficulties,and propose feasible countermeasures to improve the class search system on the basis of the experience of following the principle of precedent in the United States and the experience of using the deviation report system in Germany.Specifically,the paper is divided into three parts:introduction,body,and conclusion,and the body is divided into five chapters.The first chapter is the introduction,which illustrates the background and significance of the selected topic,the current status of domestic and foreign research,the research ideas and methods,and the innovation and shortcomings.Chapter 2 is the basic theory of case search system,which explains the basic connotation of case search system,the theoretical basis and value basis of case search system.Chapter 3 examines the current situation of the operation of the class search system in China,and discusses the dilemma of the class search system and its causes according to specific cases.Chapter 4 introduces the U.S.precedent-following principle and the German deviation reporting system,and their inspiration for the improvement of China’s class search system.The fifth chapter puts forward the suggestions for improving China’s class case search system,mainly from class case search and identification;class case understanding and application;and class case supervision and relief respectively.
