| After a hundred years of self-construction practice,the Communist Party of China has always placed party member education in an important position.Since the18 th National Congress of the Communist Party of China,the new era of socialism with Chinese characteristics has become a new historical orientation for China’s reform and development.The Central Committee of the Communist Party of China with Comrade Xi Jinping as the core has made a major decision and deployment to "comprehensively promote the rule of law and accelerate the construction of the rule of law in China",especially in the《 rule of law in China construction plan(2020-2025)》 clearly put forward the construction of a strong legal guarantee system and a perfect inner-party legal system,which puts forward new requirements for the legal guarantee of the right to education and training of party members.From the perspective of the relationship between rights and obligations within the party,the right of party members to receive education and training is not only a democratic right,but also a disciplinary obligation.The exercise of the right to education and training by party members is not only an important part of promoting rule-based party governance,but also an important manifestation of the rule of law within the party.This study takes the rule of law as the research perspective,takes the new era as the time node,takes the party members in Hangzhou as the research object to carry out empirical research,takes the definition of the right to education and training of party members in the new era as the research starting point,reviews the theoretical basis and historical process of the development of the right to education of party members,takes the improvement of the legal protection of the right to education and training of party members as the research theme,and clarifies the value implication of the legal protection of the right to education and training of party members in the new era from the four dimensions of subject,ability,system and system.At the same time,quantitative and qualitative research methods are used to sort out and analyze the practical context of Hangzhou as the legal protection of the right to education and training of party members.This paper summarizes the current situation of the protection of the right to education and training of party members in Hangzhou in the new era from four aspects: system,organization,supervision and implementation,and then combs the practical problems of the legal protection of the right to education and training of party members from the perspectives of right popularization,right application and right consciousness.Finally,it analyzes the causes of the poor effect of the legal protection of the right to education and training of party members from four aspects: the education and training system needs to be improved,the education and supervision platform is not running smoothly,the education and implementation resources are not rich enough,and the influence of the bad ruling culture within the party.On the basis of the above research,this study provides basic ideas for improving the legal protection of the right to education and training of Party members from the following four aspects.First,it is necessary to improve the system and strengthen the construction of the education law system within the party;the second is to accurately supervise and optimize the supervision mode of education and training;the third is to strictly enforce and standardize the implementation principles of education and training;fourth,to enhance awareness,training party members consciously exercise the right to education and training awareness.Through the above path,we will continue to overcome various obstacles to the protection of the right of party members to education and training,better protect the principal position of party members in the party ’s education and training work,promote the normative and rational development of the legal protection of the right of party members to education and training,and promote the improvement and development of the party ’s legal system. |
