On The Internal Dispute Resolution Mechanism Of E-commerce Platform

In recent years,e-commerce disputes have occurred frequently,while the judicial system which has long faced the pressure of too many cases,is unable to cope with it.At the moment,online dispute resolution mechanism which broke through the traditional dispute resolution mode appeared.The internal dispute resolution mechanism is an independent exploration of the e-commerce platform.Under the construction of the "online disputes,online resolution" Internet governance system,with its economic,flexible and internal characteristics,online dispute resolution mechanism play an important role gradually in dealing with e-commerce disputes.The internal dispute resolution mechanism of e-commerce platform arises from the limitations of the existing system in resolving e-commerce disputes on the one hand,and the special needs of e-commerce platform dispute resolution on the other.Based on the entrustment of power by public authorities and the transfer of rights by private entities,e-commerce platforms are able to set up internal dispute resolution mechanism above the resource advantage.According to the different subjects of dispute resolution,the internal dispute resolution mechanism of e-commerce platform can be divided into three modes:dispute resolution by the parties themselves,by the platform and by others the platform entrusted.In these three modes,disputes will be resolved according to the platform dispute resolution rules,party agreements and majority decision respectively.The three modes have different starting and processing procedures.By deconstructing the above elements,it is found that the internal dispute resolution mechanism has problems such as insufficient trust,imperfect procedures and inadequate execution.Feasible improvement paths are put forward from three aspects:professional construction of the team,procedural optimization of the mechanism and interface with external ones.
