An Empirical Study On The Reform Of Internal Institutions Of Grass-roots Procuratorial Organs

Procuratorial internal organs are the organizational carrier of the operation of procuratorial power.Whether the internal organs are reasonable or not is directly related to the full realization and effective play of procuratorial functions.Throughout the history of the internal organization setting of procuratorial organs in China,its setting is always reformed and adjusted in time with the development of economy and society and based on the evolution of procuratorial functions and the needs of practical development.A new round of reform of the internal structure of procuratorial organs is both imperative and at the right time.It is an important link of procuratorial reform in the new era.In accordance with the deployment of the Supreme Procuratorate and the spirit of comprehensively promoting the internal institutional reform of the three-level procuratorial organs,the procuratorial organs of City C successfully completed the establishment of internal institutions of the two-level procuratorates in the urban area.As the grass-roots Procuratorate in the center of C,the people’s Procuratorate of district y,according to the deployment of the superior court and combined with the actual situation of the court,has achieved good results,but there are also some problems and situations in judicial practice.Through the analysis of the relationship between the establishment of internal institutions and the actual exercise of procuratorial power,and the decomposition of the composition of procuratorial power,we can find a reasonable separation channel to adapt to the allocation of procuratorial power after the re establishment of internal institutions of procuratorial organs.The reform of the internal structure of grass-roots procuratorial organs should follow the general idea of "dividing posts by power,quantifying posts and establishing departments by quantity",follow the basic principles of attention span and management span,respect the operation law of procuratorial power,and carry out targeted implementation according to the specific conditions such as business volume,staffing and management range.At the same time,we should avoid pragmatism and utilitarianism,settle in favor of the operation of procuratorial power and the realization of judicial responsibility system,abandon the blind obedience to the "majority system" and seek to improve the actual operation efficiency.
