Data resources have great potential value,but due to the frequent occurrence of Data security incidents,data subjects lack trust in data transactions,and data transactions fail to achieve the expected results.This article analyzes this and believes that the reason for the inactivity of data transactions is that the neglect of data relationships in data governance has led to collective oppression in the process of data governance,which has increased data subjects’ distrust of data governance.And this distrust is transmitted from the data production level to the transaction level,causing market entities to gradually resist transactions.This article analyzes data governance through relational governance theory,and believes that data belongs to collective resources.In order to protect the collective interests in data relationships,more democratic governance methods should be adopted.Therefore,this article suggests introducing the data broker to promote the circulation of data.This article analyzes the experience of extraterritorial data broker systems and divides data brokers into two categories: private and public.The private is represented by the data broker in the United States,where data transactions are relatively active.However,the frequent occurrence of data leakage accidents has led to the gradual attention of the government and the introduction of a large number of laws requiring them to disclose their information,and the establishment of full-time personnel for supervision within them.The public is represented by public institutions in the EU.While focusing on protecting data security,the EU proposes to develop data intermediary services to promote data transactions.It also requires a strict disclosure system,third-party supervision,and the establishment of data intermediary management government departments.In summary,this article believes that the current data trading market in China is still in its infancy,and the trust between data subjects has not yet been fully cultivated.The data broker in China should take into account the two characteristics of democracy and collective interests to cultivate trust between data transactions.Therefore,this article proposes to establish the data broker dominated by public to guide and promote the development of non-public data brokers.In addition,in order to ensure the security of data transactions and the trust of data subjects,data brokers should be required to improve a disclosure framework and accept public supervision.At the same time,the regulatory model of data brokers should adopt a "platform + government" regulatory model.This article advocates incorporating the data broker system into the big data trading platform to ensure the strict independence of the big data trading platform itself,thereby supervising transactions.In addition,government departments should also establish relevant sectors to supervise data brokers,so as to ensure the safety of data transactions and promote data circulation.
