In recent years,with the continuous development of science and technology,the population has sharply increased,and land resources have fallen into a predicament.According to a United Nations survey,it is estimated that land resources will be depleted around 2050.Therefore,the exploration and development of marine resources are becoming increasingly important,especially the development and utilization of deep-sea seabed resources.The international seabed area mainly refers to the seabed beyond the jurisdiction of coastal countries,with an area of approximately 250 million square kilometers,accounting for 49% of the total area of the Earth.The article aims to study the conflicts in the application of the principle of human inheritance of property.By sorting out the current practice and domestic and foreign legal status,it analyzes the problems in its application.At the same time,based on the analysis and reference of foreign experience,it proposes feasible countermeasures.This article integrates knowledge and research methods from multiple disciplines such as geography,environmental science,and marine ecology to conduct a comprehensive analysis of the principle of human common inheritance of property;On the basis of comparing the similarities and differences in the provisions of this principle in different periods and international treaties,and sorting out the history and historical background of human common inheritance,this study aims to explore ways to resolve conflicts outside national jurisdiction.As a legal concept of property,the principle of common heritage of human beings is a special legal principle in international law and an important basis for safeguarding fair and equal order in the law of the sea.The principle of human common inheritance applies to areas beyond the jurisdiction of the Moon,celestial bodies,and national jurisdiction,including the subsoil,ocean floor,and seabed.It also applies to areas such as biodiversity conservation and cultural heritage property protection.The principle of common inheritance of property by mankind has become a widely recognized principle in maritime law and one of the principles applicable to international law.Therefore,resolving theoretical and practical conflicts plays an important role in safeguarding maritime rights and maintaining resource diversity. |
