| E-commerce platform is an economic form that relies on the Internet and can achieve high-quality economic development.It has three main characteristics: double(multiple)edge market attribute,network effect and lock-in effect.Because of the particularity of e-commerce platform,the limited transaction behavior of e-commerce platform has asymmetry,concealment and interaction with competitive influence.As a result,the conditions for determining whether the e-commerce platform has implemented the limited transaction behavior are very different from those of the traditional industry.At present,the determination of limited trade behavior follows three determinations: defining relevant market,then determining dominant market position,and finally analyzing competition effect.Then the examination of the identification of limited transaction behavior on e-commerce platforms can also be conducted from these three aspects.Because of the particularity of the e-commerce platform,it is difficult to define the geographical scope and substitution relationship when defining the relevant market.This paper examines the identification of dominant market position,and clarifies the existing problems in the identification of abuse of dominant market position by e-commerce platforms,such as unclear legal regulatory subjects and related responsibilities,mixed criteria for identification of dominant position,dynamic changes of platforms and high market concentration that reduce market share.Finally,from the general point of view,that is,from the whole step of identification,to inspect,analyze the shortcomings of the existing identification steps.In order to examine the existing problems in the identification of limited transaction behavior of e-commerce platform,three suggestions are put forward to improve the identification of limited transaction behavior of e-commerce platform.It is necessary to improve the definition method of the market related to the e-commerce platform,adjust the definition method of the market related to the e-commerce platform,and comprehensively consider a variety of factors to define the relevant market.Secondly,it is necessary to improve the recognition mechanism of market dominant position.First,it is necessary to optimize the presumption standard of market share.Second,it is necessary to enrich the factors for determining market dominant position.Third,it clarifies the applicable conditions for regulating abuse of dominant market position in the Anti-monopoly Law.Finally,it is necessary to explore the feasibility and applicable scheme of "R-M-C mode" and "M-C mode" in parallel,and then establish the "R-M-C mode" in the e-commerce platform market environment,and "M-C mode" in parallel with the illegality determination model.Research on the identification of exclusive dealing of e-commerce platform is conducive to the regulation of limited trading behavior of e-commerce platform,in order to create a good market competition environment,protect the legitimate interests of consumers and competing platform enterprises,and finally develop our anti-monopoly law system and promote the process of the rule of law. |
