Research On Investigation Cooperation Mechanism Between China And ASEAN In Combating Cross-border Telecom Network Fraud Crimes

Cooperative governance of transnational crime is an important issue in the relationship between China and ASEAN,which is of great significance to promote economic exchanges between the two sides and regional security and stability.In recent years,telecommunications network fraud continues to occur frequently,cross-border telecommunications network fraud crimes are increasingly rampant,and fraud methods are endless.Compared with traditional fraud crimes,it is difficult three attributes,overseas criminals have the latest network information technology means,at no cost,sitting in the town overseas remote control command,to our people’s property,personal safety interests,social public interests and national security.Bring great harm.Therefore,in the process of cracking down on cross-border telecommunications fraud crimes,is is necessary to take measures to effectively deal with cross-border telecommunications network fraud between China and ASEAN,improve the corresponding investigation and cooperation mechanisms between the two sides in international criminal justice cooperation,and enhance China’s telecommunications network security.We need to fully understand and master the difficulties in combating and investigating cross-border telecommunications network fraud crimes,and propose targeted regional investigation cooperation countermeasures to effectively suppress the occurrence of such crimes and protect the legitimate property of our people.Firstly,this paper summarizes the concept,implementation links and main types of cross-border telecom network fraud.Accurate information acquisition,communication liaison induction and fund payment transfer are the main three implementation links of telecom network fraud crime.The main types of telecom network crime include network loan fraud,bill rebate fraud,telephone fraud,and fraud by posing as agency staff,and expounds the significance of cross-border investigation cooperation.Secondly,combined with the existing domestic criminal law of our country and relevant international treaties such as international criminal judicial cooperation,this paper studies the governance of overseas telecommunication network fraud crime from both theoretical and practical perspectives.At the domestic law level,it analyzes the crime and non-crime of cross-border telecommunication network fraud from the perspective of criminal law theory.From the perspective of international law,it analyzes overseas criminal investigation and police cooperation,and makes an in-depth analysis of the current situation of cross-border telecommunication network fraud crime and investigation cooperation between China and ASEAN,including police intelligence information sharing,joint arrest of criminal suspects,transfer and repatriation of suspects.In the third part of the paper,the problems existing in the current investigation cooperation mechanism are analyzed,including the existing international criminal jurisdiction conflict,the lack of cross-border investigation police force,the difficulty of cross-border evidence collection and the objective obstacles of the legal system and judicial system.Finally,countermeasures and suggestions are put forward for the problems existing in cross-border investigation cooperation.This paper analyzes the ways to solve the conflict of jurisdiction between China and AWEAN.The two sides need to strengthen communication and exchanges,deepen law enforcement and judicial cooperation,use artificial intelligence technology to help police cooperation,optimize the operation,and further improve the investigation cooperation mechanism in intelligence sharing,evidence collection,criminal suspect arrest and other aspects,so as to fully make the cross-border investigation cooperation between China and ASEAN more effective,better deal with the occurrence of cross-border telecommunications network fraud crimes,and ensure the development of cooperative investigation work between the two sides.
