Research On The Regulation Of Township Government’s Administrative Punishment Disgraceful Behavior

The township government occupies the final position in the administrative system of our country,is the core of the grassroots social governance,plays a fundamental role in realizing the rule of law.With the continuous development of society,the task of grassroots governance is becoming more and more heavy,and the working environment faced by township governments is becoming more and more complex.The past development model that only let township governments assume management responsibilities without corresponding enforcement power is no longer suitable for the development of society.Therefore,the power of administrative punishment to the township government is a significant progress in the development of the rule of law,can greatly meet the needs of the basic-level administrative law enforcement of the township government,improve the level of dependency management and the efficiency of law enforcement,to improve the township government’s credibility,improve the basic-level administrative law enforcement system is of great significance.At the same time,it will also help promote the modernization of our governance system and governance capacity.The newly revised "Administrative Punishment Law" has explicitly stipulated that the power of administrative punishment should be exercised by township governments and sub-district offices which can effectively undertake it,but the new law always faces conflicts with the reality in practice.From the perspective of reality,township governments often face the situation of power anomy in grassroots law enforcement,which is specifically manifested as indiscriminate administrative punishment,inaction of administrative punishment,slow administrative punishment,power corruption,etc.,which is closely related to the abstract nature of legal provisions,backward law enforcement force of township,lack of effective supervision mechanism,backward construction of the rule of law in township areas and other factors.In order to give full play to the role of township government in grassroots social governance,multiple measures should be taken to regulate the administrative punishment behavior of township government.First,from the basic principles of administrative law,strengthen the role of administration by law and proportionality principle,control the enforcement power of township government at the macro level;Secondly,the relevant laws and regulations of empowerment should be perfected,and the general standards and scope of empowerment should be set up to provide correct guidance for the administrative enforcement of township governments.Then,we should standardize the administrative law enforcement of township governments,improve the coordination law enforcement mechanism between counties and townships,strengthen the training of grassroots law enforcement personnel,and promote the reasonable and efficient law enforcement of township governments.Finally,it is necessary to strengthen the supervision of administrative law enforcement of the township government,and perfect the way of the people’s right relief,so as to promote the power of the township government to operate in the sunshine.
